HomeMy WebLinkAbout19505 ORD - 09/30/1986TEXAS: AN ORDINANCE AUTHORIZING THE EXECUTION OF A LEASE AGREEMENT WITH THE CORPUS CHRISTI HOUSING AUTHORITY FOR AN APARTMENT AT CLAIRELAINE GARDENS TO BE USED BY SENIOR COMMUNITY SERVICES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager is hereby authorized to execute a two year lease agreement with the Corpus Christi Housing Authority for an apartment at Clairelaine Gardens, 3312 Wayside Drive, to be used by Senior Community Services to provide nutrition and social services to elderly residents of Clairelaine Gardens and the surrounding areas, all as more fully set forth in the lease agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A." SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned lease agreement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 30th day of September, 1986. ATTEST: ,g,,,u_.,9 City Secretary APPROVED: 7.3 DAY OF SEPTEMBER, 1986 HAL GEORGE, CITY ATTORNEY 09P.030.01 THE CITY OF CORPUS CHRISTI, TEXAS 19505 MICROFILMED TEE STATE OF TEXAS 1 COUNTY OF NUECES This Agreement, made and entered into by and between the Mousing Authority of the City of Corpus Christi, Texas, acting here through the Chairman of the Board, Mrs. Nancy W.•Stevens, (hereinafter called "The Authority"), and the City of Corpus Christi, acting herein through the City Manager, (hereinafter called "Lessee"). WITNESSETE: That the Authority has agreed to let and hereby does Iet to Lessee, the use and occupancy of an apartment located at 3312 Wayside Drive, Clairelaine Cardene, Corpus Christi, Texas, for the sole purpose of providing outreach, referral, recreation, and other supportive services to the occupants of Claitelaine Gardens and all other senior citizens of the community. That no alteration shall be made to the building or the premises without prior written approval by the Authority. Lessee shall pay to the Central Power and Light Company the cost of electricity for lighting, air con— ditioning, and any other use on the premises. Lessee shall be responsible for all janitorial service and for payment to the Authority for breakage or damage resulting from negligence of staff or participants, normal wear and tear excluded. Leesee shall furnish all supplies and materials utilized in the services. Lessee shall at alI times maintain the lease premises in a sanitary and orderly manner, including, but not limited to, insuring that the leaeed premises are refuse—free, the floors are cleaned and waxed regularly, and the kitchen and bath facilities are cleaned daily. Lessor shall be entitled to inspect the leased premises in order to ascertain whether Lessee is complying with the aforementioned obligation of Leasee to maintain the leased premises in a sanitary and orderly manner. If. in the opinion of Lessor, Lessee has not properly maintained the leaeed premises, Lessor may terminate this agreement upon ten (10) days written notice to Lessee. That the Authority shall maintain the structure and the lawn area, but furnish no office equipment or special equipment, other than the range, refrigerator, piano, and tables and chairs presently located in the apartment; the Authority will furnish water, and gas for area heating and water heating. That Lessee shall provide on-site personnel on week days for schedul- ing and directing on-going activities and other activities deemed to be of benefit to the senior citizens of the community. 0 That this Agreement shall be for a period of twenty-four (24) months unless terminated by either party giving thirty (30) days prior written notice of intent to terminatd this Agreement or unless terminated as otherwise provided herein.
