HomeMy WebLinkAbout19517 ORD - 10/07/1986AN ORDINANCE CLOSING AND ABANDONING A PORTION OF THE 7.5 FOOT WIDE UTILITY EASEMENT OUT OF LOT 27, BLOCK 8, BRIGHTON VILLAGE SUBDIVISION UNIT 4, SUBJECT TO THE PROVISIONS LISTED BELOW; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 7.5 foot wide utility easement in Lot 27, Block 8, Brighton Village Subdivision Unit 4, recorded in Volume 49, Pages 117-119, Map Records of Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a 7.5 foot wide utility easement in Lot 27, Block 8, Brighton Village Subdivision Unit 4, as recorded in Volume 49, Pages 117-119, and further described by metes and bounds attached hereto as Exhibit "A," be and the same is hereby closed for public use and every municipal purpose, subject to the property being replatted at applicant's expense. The above described utility easement is hereby abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to close and abandon the abovementioned at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or reso tions at three regular meetings so that this ordinance is pas and shall ffect upon first reading as an emergency measure this the /f76- day of , 1986. DAY OFA 1986 C Attorrley 09P.048.01 19517 MICROFILMED STATE OF TEXAS COUNTY OF NUECES FIELDNOTES for the abandonment of a portion of an existing 7.50 foot wide utility easement out of Lot 27, Block 8, Brighton Village Unit 4, a map of which is recorded in Volume 49, Pages 117 thru 119, Map Records of Nueces County, Texas: BEGINNING at the Southeast corner of this tract from which corner a 5/8 inch iron rod found on the West boundary line of Donington Drive for the Southeast -i�� corn of4said Lot 27 bears South 35°04'58" East 5.16, thence 45.53 feet, along a circular curve to the right whose radius point bears South 27°37'32" East 784.71 feet and which has a central angle of 03°19'28", a radius of 784.71 feet and a tangent distance of 22.77 feet; THENCE South 54"55'02" West 25.10 feet for a corner of this tract; THENCE North 35°04'58" West 0.50 feet for an inside corner of this tract; THENCE South 54°55'02" West 27.80 feet for the Southwest corner of this tract; THENCE North 35°04'58" West 0.81 feet to a point on the North boundary of said existing 7.50 foot wide utility easement for the Northwest corner of this tract and the beginning of a circular curve to the right whose radius point bears South 38°06'34" East 792.21 feet and which has a central angle of 03°49'39", a radius of 792.21 feet, a tangent distance of 26.47 feet and an arc length of 52.92 feet; THENCE, along said curve to the right, 52.92 feet for the Northeast corner of this tract; THENCE South 35°04'58" East 2.34 feet to the POINT OF BEGINNING and containing 98.22 square feet of land.
