HomeMy WebLinkAbout19522 ORD - 10/14/1986AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF HIGINIO J. CANTU AND MARILYN McKEITHAN BY CHANGING THE ZONING MAP IN REFERENCE TO LOT 12A, BLOCK 9, GARDENDALE No. 1, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "AB" PROFESSIONAL OFFICE DISTRICT WITH A SPECIAL PERMIT FOR A RESTAURANT ON THE NORTHWEST ONE-HALF OF THE LOT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Higinio J. Cantu and Marilyn McKeithan for amendment to the zoning map of the City of Corpus Christi. WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, September 16, 1986, at regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on Lot 12A, Block 9, Gardendale No. 1, in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B" One -family Dwelling District to "AB" Professional Office District with a special permit for a restaurant on the northwest one-half of the lot, further described by metes and bounds below, according to the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A," and subject to all other considerations of "AB" Professional Office District. 08P.179.01 The west one half of Lot 12A, Block 9, Gardendale, as shown on map recorded in Volume 52, Pages 105 and 106, of the Map Records of Nueces County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at the intersection of the west right-of-way boundary of Burton Lane with the north right-of-way boundary of Holly Road as shown on said map for the southeast corner of Block 9; THENCE North 61°00'40" West with the south boundary of Block 9, 234.00 feet to the southeast corner and POINT OF BEGINNING of this tract; 19522 MICROFILMED • THENCE continuing North 61°00'40" West with the south boundary of Lot 12A, 66.00 feet to the southwest corner of said Lot 12A and the southwest corner of this tract; THENCE North 28'59'20" East with the west line of Lot 12A, 300.00 feet to the northwest corner of said Lot 12A and the northwest corner of this tract; THENCE South 61°00'40" East with the north boundary of Lot 12A, 66.00 feet to the northeast corner of this tract; THENCE South 28°59'20" West with a line 66.00 feet from and parallel to the west line of Lot 12A, 300.00 feet to the POINT OF BEGINNING, containing in all 19,800 square feet, more or less. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutis at three regular meetings so that this ordinance is passed,And shall tak f• t upon first reading as an emergency measure this the / day of d _!` , 1986.
