AN ORDINANCE
AUTHORIZING THE EXECUTION OF SUPPLEMENTAL AGREEMENT NO. 3 TO
FAA LEASE NO. DOT-FA76SW-1196 FOR JANITORIAL SERVICE FOR
2459 SQUARE FEET LOCATED ON THE GROUND FLOOR OF THE TOWER
BUILDING WHICH SUPPLEMENTAL AGREEMENT DECREASES THE ANNUAL
RENTAL PAYMENT BY $3,860.63; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager is hereby authorized to execute
Supplemental Agreement No. 3 to FAA Lease No. DOT-FA76SW-1196 for janitorial
service for 2459 square feet located on the ground floor of the Tower Building,
which supplemental agreement decreases the annual rental payment by $3,860.63,
all as more fully set forth in the supplement agreement, a substantial copy of
which is attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need of
executing the abovementioned supplement agreement at the earliest practicable
date, such finding of an emergency is made and declared requiring suspension of
the Charter rule as to consideration and voting upon ordinances or resolutions
at three regular meetings so that this ordinance is passed and s a e effect
upon first reading as an emergency measure this the ?fii' day of

SUPPLEMENTAL AGREEMENT NO. 3
THIS SUPPLEMENTAL AGREEMENT, made and entered into this
day of 1986, by and between the UNITED STATES OF
AMERICA, hereinafter referred to as the Government, represented by the
Federal Aviation Administration, and the CITY OF CORPUS CHRISTI, TEXAS,
hereinafter referred to as the Lessor, whose address is Route 2, Box 902,
Corpus Christi, Texas 78410, WITNESSETH, That:
WHEREAS, on the 1st day of September 1975, the parties hereto entered
into Lease DOT-FA75SW-1196, as amended by Supplemental Agreement Nos. 1
and 2, dated January 10, 1978, and May 31, 1981, respectively, for the
considerations and purposes more particularly stated in said lease, as
amended; and
WHEREAS, the Government no longer has a need for janitorial services
from the City; and
WHEREAS, the aforesaid janitorial service has been valued at $1.57 per
square foot (2,459 sq. ft.) or $3,860.63 per annum; and
WHEREAS, the parties hereinto find it will be to their mutual benefit
and advantage for the purposes stated hereinabove to amend said lease.
NOW, THEREFORE, effective July 1, 1986, the parties hereto agree to
amend the basic lease in the following particulars only, VIZ:
1. DECREASE: Article 3 from $17,999.88 to $14,139.25 payable monthly
at a rate of $1,178.27.
2:CHANGE: Article 9 to read $14,],39,25.
3. ADD: Janitorial service rate to be based on economic conditions existing
at the time when service is reactivated.
ALL OTHER TERMS AND CONDITIONS of the basic lease are hereby ratified
and except as amended hereinabove shall be and remain the same.

of the date first above written.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three

and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
