HomeMy WebLinkAbout19528 ORD - 10/21/1986AN ORDINANCE AMENDING CHAPTER 17, FINANCE AND TAXATION, BY AMENDING SECTION 17-60, AUTHORITY TO SELL AT AUCTION, AND BY ADDING A SECTION 17-68, AUTHORITY TO DISPOSE OF HANDGUNS AND OTHER DANGEROUS WEAPONS, SETTING FORTH GUIDELINES FOR DESTRUCTION OF ABANDONED HANDGUNS; PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE. CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Chapter 17, Finance and Taxation, is hereby amended by amending Section 17-60; Authority to sell at auction, to hereinafter read as follows: All abandoned, stolen or recovered property of every kind, except motor vehicles, handguns, and other dangerous weapons, which shall remain in the custody of the police division for a period of forty-five (45) days, without being claimed or reclaimed by the owner, whether known or not, may be sold and disposed of at public auction as provided in this division. SECTION 2. That Chapter 17, Finance and Taxation, is hereby amended by adding Section 17-68, Authority to dispose of handguns and other dangerous weapons, to hereinafter read as follows: Notwithstanding any other provision in this division, if the property described in Section 17-60 is a handgun, a knife or similar weapon, a club or other similar weapon, or any other weapon deemed by the Police Chief to be primarily designed or usable as a weapon, the Police Chief may cause it to be destroyed, after written approval of the City Manager. Prior to such destruction, thirty (30) days notice of the destruction, and a descriptive list of the weapons to be destroyed, shall be posted at the county courthouse door and at any regular entrance to city hall, and notice of each weapon to be destroyed shall be sent by the Police Chief to the last known address of the owner or possessor by registered mail. The Police Chief shall cause to be made and maintained for two (2) years records which accurately describe each weapon destroyed, and the date and manner of destruction. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it 06P.173.01 1952 ICROFILMED shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4.
