AMENDING ORDINANCE NO. 6106, THE ZONING ORDINANCE OF THE
CITY OF CORPUS CHRISTI, AS AMENDED, BY AMENDING ARTICLE 28,
ENTITLED PLANNED UNIT DEVELOPMENT; AND PROVIDING FOR
SEVERANCE; AND DECLARING AN EMERGENCY.
WHEREAS, it is the desire of the City Council to change the Zoning
Ordinance regulations governing the development of Planned Unit Developments so
that the failure to develop an entire development plan shall not result in the
automatic termination of the approved plan as to those portions of the plan for
which development has been completed.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That Section 28-5(H), entitled Time Limit, of the Corpus
Christi City Zoning Ordinance is hereby amended by ending the last sentence of
the first paragraph of said Section by deleting the comma following the word
"District" and substituting a period therefor, and deleting the remainder of
said last sentence of the first paragraph, and adding a new last sentence to
hereafter read as follows:
Provided, however, where distinct segments of the plan have
been completed, the plan of development shall not be void as
to such completed segments, if the completed segments,
standing alone, are found by the Planning Commission to be
consistent with the planned unit development concept
recognized in this article.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient and effective administration of City affairs, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to
consideration and voting upon ordinances or resolutions at three regular
meetings so that this ordinance is passed and shall take effect upon first
reading as an emergency measure this the day of
1986.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
