HomeMy WebLinkAbout19532 ORD - 10/28/1986AN ORDINANCE AUTHORIZING THE EXECUTION OF A CONTRACT WITH MALCOLM PIRNIE, INC., FOR DESIGN WORK FOR INTERIM IMPROVEMENTS TO THE OSO WASTEWATER TREATMENT PLANT; APPROPRIATING $75,000; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1.. That the City Manager is hereby authorized to execute a contract with Malcolm Pirnie, Inc., for design work for interim improvements to the Oso Wastewater Treatment Plant, all as more fully set forth in the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated $75,000 from the No. 250 Sanitary Sewer Bond Fund, applicable to Project No. 250-85-44-5.1, Oso Improvements. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned contract at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 28th day of October, 1986. DESCRIPTION OF PROJECT The following items represent plant modifications, features, and/or improvements to the Oso Wastewater Treatment Plant for which the Engineer will provide engineering services as described herein. A. Items to be Performed by Contract Construction: 1. Means to isolate flow to each mixing basin, reaeration basin, clarifier, and chlorine contact basin. 2. Improvements to the effluent flow metering system to improve rangeability. B. Items to be Performed by City Crews: 1. Installation of improved blower controls to save energy. 2. Modification of sludge pumping systems to simplify them and reduce maintenance and energy costs. 3. Improvements to clarifier inlet to eliminate scum accumulation problem. 4. Addition of ventilation to improve the environment in the belt press room so as to minimize odors and corrosion as well as maintain a comfortable temperature in the winter time. • II. SCOPE OF SERVICES The Basic Services to be provided by the Engineer shall be in accordance with the Manual of Practice, General Engineering Services, as_ published in 1982 by the Texas Society of Professional Engineers and Consulting Engineers Council of Texas and will include the following: A. Preliminary Phase Preliminary engineering services under this Contract shall include: 1. Conduct initial planning meetings with the City for the following purposes: ENGINEERING SERVICES CONTRACT - OSO WWTP Malcolm Pirnie, Inc. Page 1 of 6 a. Confirming and refining project scope and final 'deliverable items. b. Establishing time requirements and target dates completion of portions of the work. c. Identifying key contact personnel for the project. for d. Establishing lines of communication with City personnel. 2. Review existing data, reports, plans and specifications bearing on the project as follows: a. b. Obtain appropriate data, reports, plans and specifi- cations from the City. Review and tabulate required information. 3. Determine existing conditions as follows: a. Visit the plant site to verify existing pertinent drawings. b. Note modifications to treatment plant personnel. made by City c. Note the condition of equipment and structures involved in the project. 4. Evaluate current plant operations as follows: a. Interview the plant operators regarding maintenance problems. b. Recommend supplemental sampling and conducted by City personnel as required.• - 5. Prepare preliminary design summaries, construction cost estimates for the following a. Effluent flow metering. b. Isolation of major unit process modules and equipment. c. Blower control. d. Sludge pumping. e. Modifications to prevent scum accumulation clarifier walkways. f. Page 2 of 6 under Construction cost estimates will be based on the assumption that Items a and b will be done by contract construction and that all other work will be done by City forces. 6. Prepare a brief, streamlined preliminary engineering report containing the following items: a. Summary of preliminary engineering work performed. b. Preliminary design summaries, sketches and construction cost estimates for work to be implemented with currently available funds. (See Paragraph 5) 7. Submit 5 copies of the draft report for review. After receiving City review comments, make necessary revisions and submit 15 copies of the final report. B. Design and Construction Phases 1. For the effluent flow metering and basin isolation improvements which will be done by contract construction, the ' Engineer will do the following. a. Design improvements and prepare construction drawings and specifications. Drawings are to be bound with specifications. Engineer to pay cost of all printing. b. Prepare construction cost estimate(s). c. Assist the City with advertisement for bids, including the preparation of any addenda and attendance at pre-bid meeting if one is requested. d. Assist the City in awarding contract(s) by reviewing bids • and making recommendations. e. General observation of the work and interpretation of the plans and specifications by periodic visits (as distinguished from the continuous services of a resident project representative) to the site. In performing these services, the Engineer will endeavor to protect the City against defects and deficiencies in the work of the_ contractor, but he cannot guarantee the performance of the contractor nor be responsible for the actual supervision of construction operations or for the safety measures that the contractor takes or should take. f. Review shop drawings. g. Preparation of change orders and monthly and final estimates for payment to the contractor based on contractor's submittal. Represent the City in interpreting and rendering decisions on the requirements of the contract documents and claims or disputes between the contractor and the City to include any disputes or claims made by the City against the contractor within one year of the final inspection; instruct the contractor on behalf of the City (including preparation of supplementary drawings or instructions required to effectuate the intent of the contract documents). 1. Conduct the final inspection. J. Revision of the construction drawings to show the project as actually constructed and the furnishing of "as -built" reproducible drawings. 2. For all other items to be -funded from current budget and to be built by City forces, the Engineer will: a. Prepare specifications for purchase of required equipment, if required. b. Provide assistance during construction by furnishing sketches of installation details and answering questions. Engineer's labor for this task is limited to 200 hours. III. SCHEDULE The Engineer agrees to begin work promptly after receipt of written authorization to proceed from the City and to perform the work as expeditiously as possible. Every reasonable effort will be made to complete the work in accordance with the following schedule: Preliminary Engineering Phase: 8 weeks Design Phase: 16 weeks Construction Phase: To Suit City Schedule IV. PAYMENT For the work described under Section II, the total compensation to - the Engineer shall be a fixed price of Seventy -One Thousand Five Hundred Dollars ($71,500.00). Engineer will submit monthly invoices for services rendered. The invoices will be based on Engineer's estimate of the proportion of the total services actually completed at the time of billing. City shall make payments within 45 days after receipt of Engineer's invoices. ENGINEERING SERVICES CONTRACT - OSO WWTP Malcolm Pirnie, Inc. Page 4 of 6 In the event that performance of the services under this Contract iS delayed for reasons beyond the control of the Engineer or because the scope of such services is changed, the amounts set forth herein shall be subject to adjustment. V. TERMINATION OF CONTRACT The City may, at any time, with or without cause, terminate this contract upon seven (7) days written notice to the other at the address of record. In this event, the Engineer shall be compensated for his services on all stages authorized as follows: A. If termination occurs prior to the final completion and approval of drawings and specifications, the Engineer shall be paid a reasonable compensation for the services actually rendered by him in proportion to the amount of work performed on such stages or phases for which he has been authorized to perform services. B. The foregoing shall not be construed to require the City to compensate the Engineer for any services not performed in a proper professional manner suitable for use in the construction of the project contemplated by the parties to this Contract. VI. ENGINEER'S LIABILITY Acceptance and approval of the final plans by the City shall not constitute nor be deemed a release of the responsibility and liability of the Engineer, its employees, associates, agents and consultants, for the accuracy of the documents and work prepared by the Engineer, nor shall such approval be deemed to be an assumption of such responsibility by the City for any defect in designs, working drawings, and specifications or other documents prepared by the Engineer, its employees, subcontractors, agents and consultants. VII. OWNERSHIP OF DOCUMENTS Upon completion of the design phase of the project, the Engineer shall furnish to the City, in a suitable container for filing, "record drawings" reproduced on linen or mylar drafting film from the original drawings, together with a correct and legible set of specifications. VIII. ASSIGNABILITY The Engineer shall not assign, transfer or delegate any of his obligations or duties in this Contract to any other person without the prior written consent of the City, except for routine duties delegated to personnel of the Engineer's staff. If the Engineer is a partnership, in the event of termination of the partnership, this Contract shall inure to the individual benefit of such partner or partners as the City may designate. No part of the Engineer's fee may be assigned in advance of receipt by the Engineer without written consent of the City. ENGINEERING SERVICES CONTRACT - OSO WWTP Malcolm Pirnie, Inc. Page 5 of 6 IX. TECHNICAL ASSISTANCE AND CONSULTATIONS/REPRESENTATIONS The City shall not pay the fees of expert or technical assistance and consultants unless such employment, including the rate of compensation, has been approved in writing by the City. It is understood, however, that the Engineer shall employ the services of the individuals stated in the Malcolm Pirnie, Inc. proposal submittal to the City on the Oso Plant Improvement project dated May 21, 1986. X. NOTIFICATION All notices given pursuant to the provisions of this Contract shall be made in writing, and all notices, correspondence and documentation shall be delivered in person or mailed postage prepaid addressed to the applicable party as follows: FOR CITY: City Engineer City of Corpus Christi P.
