HomeMy WebLinkAbout19535 ORD - 10/28/1986TEXAS: AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CHAPTER 6, ANIMAL CONTROL, SECTION 6-25, LOAN OF SMALL ANIMAL TRAPS, TO EXEMPT LOW INCOME CITIZENS FROM FEES AND DEPOSITS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That Section 6-25, Loan of small animal traps, of Chapter 6, Animal Control, is hereby amended to read as follows: Sec. 6-25. Loan of small animal traps. Small animal traps will be loaned by the animal control division for a charge of one dollar ($1.00) per day. There will be a required deposit of ten dollars ($10.00) prior to the loan of these traps. The following shall be exempt from said charges and deposit: (1) disabled citizens, (2) citizens age 65 or older who live alone, and (3) low income citizens, below the poverty level as established by the Texas Department of Human Resources. Provided, however, that to obtain such an exemption on a deposit, the exempted citizen shall be required to state in a written agreement that he or she is entitled to the exemption, and that if the trap is not returned to the City for any reason, City shall be entitled to add ten dollars ($10.00) to his or her utility bill. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption stating in substance the purpose of the ordinance, this ordinance to become effective upon such publication. SECTION 4.
