HomeMy WebLinkAbout19537 ORD - 10/28/1986AN ORDINANCE ANNEXING AN 11 ACRE TRACT OF LAND OUT OF LOTS 9-14 AND 19-24, SECTION 6, FLOUR BLUFF ENCINAL FARM AND GARDEN TRACTS, OWNED BY THE CITY OF CORPUS CHRISTI. WHEREAS, on October 6, 1986, and October 7, 1986, public hearings were duly held following publication of due notice of said hearing in the official newspaper, pursuant to Article 970a, V.A.C.S., Texas, as amended, for the consideration of institution of proceedings for the annexation of defined area wholly within the extraterritorial jurisdiction of the City of Corpus Christi, more particularly described by metes and bounds as hereinafter set forth, at which all interested persons were afforded an opportunity to be heard, and by motion duly made, seconded and carried the said hearing was closed October 7, 1986; and WHEREAS, it has been determined by the City Council that the territory within said tract or parcel of land, now proposed to be annexed, abuts and is contiguous and adjacent to the City of Corpus Christi and constitutes lands and territories subject to contractual annexation as provided by the City Charter Article I, Section 2c; and WHEREAS, it has been determined that it would be advantageous to the City and to its citizens and in the public interest to annex the aforesaid lands and territory hereinafter described: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF' CORPUS CHRISTI, TEXAS: SECTION 1. That the tract or parcel of land described as 11 acres out of Lots 9-14 and 19-24, Section 16, Flour Bluff Encinal Farm and Garden Tracts, and described by metes and bounds as follows, is hereby annexed: 09P.082.01 Fieldnotes for a 120.00 foot wide tract of land out of Lots 9 thru 14 and Lots 19 thru 24, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41 thru 43, Map Records of Nueces County, Texas: COMMENCING at the centerline intersection of 120 foot wide Yorktown Blvd. and 100 foot wide South Staples Street for the common corner of Lots 9 and 24, Section 6, and Lots 16 and 17, Section 10, of said Flour Bluff and Encinal Farm and Garden Tracts, from which point the Southeast corner of this tract bears South 28°56'00" West 70.00 feet thence North 61°04'00" West 50.00 feet to the point of curvature of a circular left on the Northwest Right of Way line of said 100 foot wide South Staples Street and the point of beginning; 19537 MICROF IL.MED THENCE, with said curve to the left whose radius point bears North 61°04'00" West 10.00 feet and which has a central angle of 89°57'10", a radius of 10.00 feet, a tangent distance of 9.99 feet, a distance of 15.70 feet to its point of tangency; THENCE North 61°01'00" West 1171.34 feet to the point of curvature of a circular curve to the left whose radius point bears South 28°58'50" West 10.00 feet and which has a central angle of 90°00'00", a radius of 10.00 feet, a tangent distance of 10.00 feet and an arc length of 15.71 feet; THENCE, with said curve to the left, 15.71 feet to a corner of this tract; THENCE North 61°01'10" West 60.00 feet to a corner of this tract and the point of curvature of a circular curve to the left whose radius point bears North 61°01'10" West 10.00 feet and which has a central angle of 90°00'00", a radius of 10.00 feet, a tangent distance of 10.00 feet and an arc length of 15.71. THENCE, with said curve to the left, 15.71 feet to the point of tangency; THENCE North 61°01'10" West 474.61 feet to the point of curvature of a circular curve to the left whose radius point bears South 28°58'50" West 10.00 feet and which has a central angle of 90°00'00", a radius of 10.00 feet, a tangent distance of 10.00 feet and an arc length of 15.71 feet; THENCE, with said curve to the left, 15.71 feet to a corner of this tract; THENCE North 61°10'10" West 60.00 feet to a corner of this tract and the point of curvature of a circular curve to the left whose radius point bears North 61°01'10" West 10.00 feet and which has a central angle of 90°00'00", a radius of 10.00 feet, a tangent distance of 10.00 feet and an arc length of 15.71 feet; THENCE, with said curve to the left, 15.71 feet to the point of tangency; THENCE, North 61°01'10" West 865.30 feet to the point of curvature of a circular curve to the left whose radius point bears South 28°58'50" West 10.00 feet and which has a central angle of 90°01'30", a radius of 10.00 feet, a 09P.082.01 tangent distance of 10.01 feet and an arc length of 15.71 feet; THENCE, with said curve to the left, 15.71 feet to a corner of this tract; THENCE, North 61°00'40" West 60.00 feet to a corner of this tract and the point of curvature of a circular curve to the left whose radius point bears North 61°02'40" West 10.00 feet and which has a central angle of 89°58'30", a radius of 10.00 feet, a tangent distance of 10.00 feet and an arc length of 15.71 feet; THENCE, with said curve to the left, 15.71 feet to the point of tangency; THENCE, North 61°01'10" West 1155.06feet to a point on the present city limit line as established by Ordinance No. 18552 dated November 13, 1984, the common boundary line between Lots 14 and 15, Section 6, Flour Bluff and Encinal Farm and Garden Tracts for the Southwest corner of this tract; THENCE, North 28°56'50" East along said common boundary line, a distance of 120.00 feet for the Northwest corner of this tract; THENCE, South 61°01'10" East with the present North Right of Way line of 120 foot wide Yorktown Blvd., a distance of 3906.26 feet to' the point of curvature of a circular curve to the left whose radius point bears North 28°58'50" East 10.00 feet and which has a central angle of 90°02'50", a radius of 10.00 feet, tangent distance of 10.01 feet and an arc length of 15.72 feet; THENCE, with said curve to the left, 15.72 feet to a point on the Northwest Right of Way line of 100 foot wide South Staples Street and the Northeast corner of this tract; THENCE, South 28°56'00" West 140.00 feet to the point of beginning; CONTAINING 11.00 acres, more or less. The above described area shall hereafter be a part of the City of Corpus Christi, Texas, and shall be subject to the general laws of the State of Texas, the City Charter, and the ordinances, resolutions, motions, laws, rules and regulations of the City of Corpus Christi, to all intents and purposes as the present City of Corpus Christi is so subject, and subject to all the rights, privileges and burdens thereof. 09P.082.01 SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. • -• :• "4.' • 6 ' • .21ter i \ 1 \ \\\ \.„.
