HomeMy WebLinkAbout19566 ORD - 12/09/1986AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 A SUBSECTION SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF LAND DESCRIBED AS A PORTION OUT OF LOT 1, SECTION 11, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Dr. Patrick J. Moran, for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, December 9, 1986, at regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and that permanent zoning of "B-4" General Business District, more fully described hereinafter, be granted; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare of the City and its citizens: i NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That there is hereby amended Article 31 of the Zoning Ordinance, Section 31-5, by adding a new subsection to hereafter read as follows, such zoning classification of the hereinafter described property to be effective upon annexation: 09P.183.01 "'MICROFILMED "Section 31-5. The following described tracts of land shall be zoned and classified as follows: "B-4" General Business District FIELDNOTES for a 7.11 acre tract of land, more or less, out of Lot 1, Section 11, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41 thru 43, Map Records of Nueces County, Texas: BEGINNING at a point on the Southwest boundary line of Saratoga Boulevard (120.00 feet wide) for the North corner of this tract, from which corner the centerline intersection of Saratoga Boulevard and South Staples Street for the North corner of said Lot 1, bears North 29°02'00" East 60.00 feet, thence North 60°58'00" West 230.19 feet; THENCE South 60°58'00" East, along the Southwest boundary line of Saratoga Boulevard, parallel to its centerline and 60.00 feet distant therefrom, measured at right angles thereto, 331.65 feet for the upper East corner of this tract; THENCE South 29°02'00" West 630.00 feet for the South corner of this tract; THENCE North 60°58'00" West 510.00 feet for the lower West corner of this tract; THENCE North 28°57'00" East, parallel to the centerline of South Staples Street and 50.00 feet distant therefrom, measured at right angles thereto, 154.15 feet for a corner of this tract; THENCE South 60°58'00" East, along the Southwest boundary line of an existing lift station site, 40.00 feet for the South corner of said lift station site and the inside corner of this tract; THENCE North 28°57'00" East, along the Southeast boundary line of said lift station site, 50.00 feet for the East corner of said lift station site and an inside corner of this tract; THENCE North 60°58'00" West, along the Northeast boundary line of said lift station site, 40.00 feet for a corner of this tract; THENCE North 28°57'00" East, parallel to the centerline of South Staples Street and 50.00 feet distant therefrom, 09P.183.01 measured at right angles thereto, 89.54 feet for a corner of this tract; THENCE North 34°21'38" East 100.50 feet for a corner of this tract; THENCE North 28°57'00" East 150.60 feet for the upper West corner of this tract; THENCE South 87°45'00" East, along the South flared right-of-way of Saratoga Boulevard, 190.06 feet for the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved of the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6.
