HomeMy WebLinkAbout19567 RES - 12/16/1986A RESOLUTION SUPPORTING LEGISLATION TO STRENGTHEN TRAFFIC SAFETY REGARDING DRIVING WHILE INTOXICATED; AND DECLARING AN EMERGENCY. Such but not be limited to the following state (1) An open container law, as defined in SB 2 of 1982; (2) A 0.05 percent blood alcohol level as per se evidence of impairment; (3) Administrative revocation of drivers' licenses for at least 90 days on first offense D.W.I. or refusal to take the alcohol test; (4) Mandatory imprisonment or community service for D.W.I. offenders or for driving with suspended or revoked licenses; (5) Preliminary alcohol testing of D.W.I. suspects before arrest; (6) D.W.I. plea bargaining excluded; (7) Withdraw drivers' licenses of persons under the age of 21 years, until they reach the age of 21 years, for D.W.I. conviction or alcohol test refusal; (8) Consider a D.W.I. offender who has caused the death of another person to have committed voluntary manslaughter rather than involuntary manslaughter, as at present. Anyone who drinks alcohol and drives does so voluntarily. He should be responsible for his actions --and deserves the more severe penalties; (9) A minimum treatment of three months in an alcohol rehabilitation center for repeat D.W.I. offenders; (10) Raise the taxes on alcoholic beverages to help finance this program. 01P.023.01 19567 MICROFILMED SECTION 2. That the City Secretary is instructed to forward certified copies of this resolution to the honorable members of the Corpus Christi legislative delegation as well as all members for the Regular Session of the 70th Texas Legislature. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the necessity of endorsing such recommendations to alleviate the continuing harm and damages to property caused by intoxicated drivers, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or r solutions at three regular meetings so that this resolution is pasr and shall ake effect' upo� first reading as an emergency measure this the {+t. day of 19b ATTEST: fah„, City Secretary APPROVED: %(p DAY OF , 19BG.
