HomeMy WebLinkAbout19581 ORD - 12/23/1986AN ORDINANCE CLOSING AND ABANDONING FIVE PORTIONS OF UTILITY EASEMENTS WITHIN LOTS 1, 2, 3, SUNRISE MALL SUBDIVISION AND A PORTION OF UTILITY EASEMENT IN LOT 2A, BLOCK D, SUBJECT TO THE PROVISIONS LISTED BELOW; EMERGENCY. THE 10 -FOOT WIDE AND 4, BLOCK 1, THAT 10 -FOOT WIDE WILKEY ADDITION, AND DECLARING AN WHEREAS, there exists five portions of the 10 -foot wide utility easements within Lots 1, 2, 3, and 4, Block 1, Sunrise Mall Subdivision shown by plat in Volume 45, Pages 96 and 97, Map Records, Nueces County, Texas, and a portion of that 10 -foot wide utility easement in Lot 2A, Block D, Wilkey Addition shown by plat in Volume 39, Page 182 and 183, Map Records, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That five portions of the 10 -foot wide utility easements within Lots 1, 2, 3, and 4, Block 1, Sunrise Mall Subdivision shown by plat in Volume 45, Pages 96 and 97, Map Records, Nueces County, Texas, and a portion of that 10 -foot wide utility easement in Lot 2A, Block D, Wilkey Addition shown by plat in Volume 39, Pages 182 and 183, Map Records, Nueces County, Texas, and all shown and described by attached exhibits, be and the same is hereby closed for public use and every municipal purpose, providing applicant reroute or pay relocation costs for the existing water and sanitary sewer lines, Central Power and Light cables, and a gas service line therein, providing applicant sign a temporary blanket easement with Central Power and Light, and subject to the property being replatted at applicant's expense. The above described utility easement is hereby abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3.
