AUTHORIZING THE EXECUTION OF AMENDMENT NO. 1 TO THE CONTRACT
FOR ENGINEERING SERVICES WITH BLACK & VEATCH FOR THE RAW
WATER STORAGE RESERVOIR AND SLUDGE LAGOONS TO INCLUDE THE
DESIGN OF A SURGE RELIEF FACILITY AT THE CALDWELL STREET
RESERVOIR AND PUMP STATION SITE; APPROPRIATING $8,500; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute
Amendment No. 1 to the contract for engineering services with Black & Veatch for
the Raw Water Storage Reservoir and Sludge Lagoons to include the design of a
surge relief facility at the Caldwell Street reservoir and pump station site,
all as more fully set forth in the amendment, a substantial copy of which is
attached hereto and made a part hereof, marked Exhibit "A."
SECTION 2. That there is hereby appropriated $8,500 from the No. 205
Water Bond Fund applicable to project 205-81-44-10.1, Stevens Plant Sludge
Lagoon.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need of
executing the abovementioned amendment at the earliest practicable date, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances or resolutions at three
regular meetings so that this ordinance is passed and shall take effect upon

The City of Corpus Christi, Texas, hereinafter called "City" and Black &
Veatch, hereinafter called "Engineer", agree to the following amendment to the
contract for Engineering Services' for the Raw Water Reservoir and Sludge
Lagoon at the 0.N. Stevens Water Treatment Plant which was authorized by
Ordinance No. 19347 on June 10, 1986.
Section I, Services to be Performed, shall be amended to include:
Surge Relief Device: Design and plan a surge relief device at the Caldwell
Pumping Station site. This device shall protect the water distribution system
in the "downtown" area from pressure surges. This device shall replace the
surge relief function of the Sam Rankin Street Water Storage Tank which is
scheduled for demolition.
Section II, Scope of Services, shall be amended to add the following
items of work to the contract:
A. In the Preliminary Phase
9. Evaluate potential sources of surge in the Downtown Water Distribution
System. Evaluate and size surge tank and surge relief valve
alternatives. Prepare opinions of probable construction cost. Submit
letter of recommendation.
B. In the Design Phase
8. Prepare technical drawings and specifications for the recommended and
approved surge relief device.
E. Order of Service, add
Engineer agrees to begin work immediately on the aforementioned Item A, 9 upon
approval of this amendment by the City Council and written notice to proceed.
Work on Item B, 8 shall commence upon approval of preliminary recommendation
by City.
All work relating to the surge relief device shall be completed within 45
calendar days of notice to proceed. The time for review of the preliminary
phase work and approval of same shall not be counted' toward the 45 day
completion schedule.
Section III, Fee, shall be amended to provide additional compensation to
the Engineer as follows:
C. Payment of Fee for Surge Relief Device
For services rendered relating to Section II, A, 9 and Section 11, B, 8, the
City will pay the Engineer a fee not to exceed Eight Thousand Five Hundred
Dollars ($8,500.00). Final payment will be made on the basis of:

actual payroll costs (direct salaries plus payroll burden, i.e.,
vacation, sickleave, F.I.C.A., unemployment and workmens
compensation, insurance, etc.) times a multiplier of 2.1 and
2. direct expenses (travel, subsistence, telephone, computer,
reproduction, equipment rental, etc.) times a multiplier of 1.1
evidenced by the submission of certified invoices.
All other terms and conditions of the contract approved on June 10, 1986,
by the City and Engineer, not specifically addressed herein, shall remain in
full force and effect.
