HomeMy WebLinkAbout19595 ORD - 12/30/1986AN ORDINANCE CLOSING AND ABANDONING THE 40 -FOOT WIDE UNOPENED PUBLIC RIGHT-OF-WAY IN LOTS 30 THROUGH 32, SECTION 21, AND LOTS 1 THROUGH 3, SECTION 22, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; PROVIDING FOR REPLATTING; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing concerning the closing of the 40 -foot wide upopened public right-of-way in Lots 30 through 32, Section 21, and Lots 1 through 3, Section 22, Flour Bluff and Encinal Farm and Garden Tracts, was given by publication and mailed to the last known addresses of the owners of property abutting the public way and within 450 feet of the area proposed to be closed, and thereafter, pursuant to said notice, public hearing was held at regular Council Meeting by the City Council of the City of Corpus Christi on December 30, 1986, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the aforesaid portion of right-of-way, proposed to be closed, is not needed now, nor will they be within the foreseeable future needed as public rights-of-way, and that the same should revert to the abutting property owners, subject to certain specified conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby closed and abandoned the 40 -foot wide unopened public right-of-way in Lots 30 through 32, Section 21, and Lots 1 through 3, Section 22, Flour Bluff and Encinal Farm and Garden Tracts, as shown by plat in Volume A, Pages 41 through 43, Map Records, Nueces County, Texas, and described by the metes and bounds which are attached hereto and made a part hereof, marked Exhibit "A", providing for replatting. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. i,SECTION 3. That upon written request of the Mayor or five Council members; co'py attached, to find and declare an emergency due to the need to close and 'abandon the abovementioned public right-of-way at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or O1P.027.01 19595 MICROFILMED resolutions at three regular meetings so that this ordinance is passed and shall tage C ffec up ' n 1ff * t reading as an emergency measure this the iiD4#1 day of ATTEST: C t ecretary // APPROVED?' : DAY OF cL..ye,r , 19 HAL GEORGE, CITY ATTORNEY By Assistant City / erney O1P.027.01 t MAY R THE CITY OF CORPUS CHRISTI, TEXAS FIELDNOTES for the abandoment of a 40.00 foot wide right-of-way out of Lots 30, 31 and 32, Section 21 and Lots 1, 2, and 3, Section 22, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41 thru 43, Map Records of Nueces County, Texas: BEGINNING at a point being South 60057'10" East 20.00 feet from the centerline of County Road No. 13 (Cimarron Boulevard), for the Northwest corner of this right-of-way from which corner the Southwest corner of Lot 32, Section 21 and the Northwest corner of Lot 1, Section 22 bears South 29°02'50" West 20.00 feet and North 60°57'10" West 20.00 feet; THENCE South 60°57'10" East, parallel to the common section line of said Sections 21 and 22 and 20.00 feet distant therefrom, measured at right angles thereto, 1960.30 feet to a point on the East boundary of said Lot 30, Section 21 for the Northeast corner of this right-of-way; THENCE South 29002'45" West, along the East boundary of said Lot 30, Section 21, at 20.00 feet pass the southeast corner of said Lot 30 and the Northeast corner of said Lot 3, Section 22 and continuing South 29°02'45" West, along the East boundary of said Lot 3, Section 22, in all a distance of 40.00 feet for the Southeast corner of this right-of-way; THENCE North 60°57'10" West, parallel to the common section line of said Sections 21 and 22 and 20.00 feet distanc therefrom, measured at right angles thereto, 1960.30 feet to a point being South 60057'10" East 20.00 feet from a point on the centerline of County Road No. 13 for the Southwest corner of this right-of-way; THENCE North 29002'50" East, at 20.00 feet pass the common lot line of Lot 1, Section 22 and Lot 32, Section 21, in all a distance of 40.00 feet to the POINT OF BEGINNING and containing 1,80 acres of land, more of less.
