AMENDING SECTION 105.4 OF THE MECHANICAL CODE ADOPTED BY
ORDINANCE NO. 19288 TO PROVIDE CLARIFICATION TO PROCEDURES
FOR THE CANCELING OF ACTIVE PERMITS; PROVIDING FOR
SEVERANCE; AND PROVIDING FOR PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That Section 105.4 of the Mechanical Code, Ordinance
No. 19288, approved by the City Council on April 29, 1986, is hereby amended to
hereafter read as follows:
105.4 - Permits for Part Jobs
When one person licensed as an air conditioning contractor
obtains a permit and partially completes the work authorized
by said permit, and then a second person licensed as an air
conditioning contractor is called upon to complete the work,
a separate permit is required for which regular fees shall
be paid for the amount of work to complete the project.
Each person shall be responsible for the portion of the work
to be installed.
Before the second person is issued a new permit for the
completion of the installation of fixtures or equipment, the
owner, builder or contractor is required to give written
notification to the Chief Plumbing/Mechanical Inspector that
he is terminating or dismissing the person holding the first
permit and give the reason why. The Chief Plumbing/
Mechanical Inspector shall then make a reasonable attempt to
notify the person who is being terminated. A minimum 24
hour waiting period shall transpire between notification to
the first permit holder and issuance of the second permit.
If the first permit holder cannot be notified within a 72
hour period, the Chief Inspector may issue the second permit
causing the first permit to be canceled. No refund of fees
shall be made.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption stating in
substance the purpose of the ordinance, this ordinance to become effective upon
such publication.
