CLOSING AND ABANDONING TWO 10 -FOOT BY 60 -FOOT PORTIONS OF
PUBLIC RIGHT-OF-WAY DESCRIBED IN VOLUME 2001, PAGES 894 TO
897, NUECES COUNTY DEED RECORDS; PROVIDING FOR SEVERANCE;
AND DECLARING AN EMERGENCY.
WHEREAS, notice of the time and place for holding a hearing concerning
the closing of two 10 -foot by 60 -foot portions of public street right-of-way was
given by publication and mailed to the last known addresses of the owners of
property abutting the public way and within 450 feet of the area proposed to be
closed, and thereafter, pursuant to said notice, public hearing was held at
Regular Council Meeting by the City Council of the City of Corpus Christi on
December 30, 1986, in accordance with the provisions of the City Charter; and
WHEREAS, it was determined by the City Council after such hearing that
the aforesaid portion of right-of-way, proposed to be closed, is not needed now,
nor will they be within the foreseeable future needed as public rights-of-way,
and that the same should revert to the abutting property owners:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby closed and abandoned two 10 -foot long
by approximately 60 -foot wide portions of public street right-of-way described
by instrument in Volume 2001, Pages 894 to 897, Deed Records, Nueces County,
Texas, and described by the metes and bounds which are attached hereto and made
a part hereof, marked Exhibits "A" and "B".
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance, for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
close and abandon the abovementioned street rights-of-way at the earliest
practicable date, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances or
resolutions at three regular meetings so that this ordinance is passe�d and shall
t ke effect upon first reading as an emergency measure this the (nsday of
1987.

certain 120.00 foot wide right-of-way (Yorktown Boulevard) which was conveyed to
the city of Corpus Christi by Volume 2001, Pages 894 thru 897, Deed Records of
Nueces County, Texas; said tract also being out of Lot 23, Section 6, Flour Bluff
and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages
41 thru 43, Map Records of Nueces County, Texas:
BEGINNING at the Northeast corner of this tract for the beginning point of
a circular curve to the left whose radius point bears South 28°58'50" West 10.00
feet and which has a central angle of 90°00'00", a radius of 10.00 feet, a tangent
distance of 10.00 feet and an arc length of 15.71 feet, from which corner the center-
line intersection of Yorktown Boulevard and South Staples Street for the common
corner of Lot 9 and 24, Section 6 and Lots 16 and 17, Section 10 bears North
28°58'50" East 60.00 feet, thence South 61°01'10" East 1231.28 feet;
THENCE, along said curve to the left, 15.71 feet for the Southeast corner of
this tract;
THENCE North 61°01'10" West 60.00 feet for the Southwest corner of this tract
and the beginning of a circular curve to the left whose radius point bears North
61°01'10" West 10.00 feet and which has a central angle of 90°00'00", a radius of
10.00 feet, a tangent distance of 10.00 feet and an arc lengthof 15.71 feet;
THENCE, along said curve to the left, 15.71 feet for the Northwest corner
of this tract;
THENCE South 61°01'10" East 80.00 feet to the POINT OF BEGINNING,

BEGINNING at a point on the South boundary line of said 120.00 foot wide
right-of-way for the Northeast corner of this tract and the beginning of a
circular curve to the left whose radius point bears South 28°58'50" West 10.00
feet and which has a central angle of 90°00'00", a radius of 10.00 feet, a
tangent distance of 10.00 feet and an arc length of 15.71 feet, from which
corner the centerline intersection of said Yorktown Boulevard and South Staples
Street, for the common corner of Lots 9 and 24, Section 6 and Lots 16 and 17,
Section 10 of said Flour Bluff and Encinal Farm and Garden Tracts, bears North
28'58'50" East 60.00 feet, thence South 61°01'10" East 1785.89 feet;
THENCE, along said circular curve to the left, 15.71 feet for the Southeast
corner of this tract;
THENCE North 60`01'10" West, parallel to the centerline of Yorktown Boulevard
and 70.00 feet distant therefrom, measured at right angles thereto, 60.00 feet for
the Southwest corner of this tract and the beginning of a circular curve to the
left Whose radius point bears North 60°01'10" West 10.00 feet and which has a
central angle of 90°00'00", a radius of 10.00 feet, a tangent distance of 10.00
feet and an arc length of 15.71 feet;
•THENCE, along said curve to the left, 15.71 feet for the Northwest corner of
this tract;
THENCE South 60°01'10" East, parallel to the centerline of Yorktown Boulevard
and 60.00 feet distant therefrom, measured at right angles thereto, 80.00 feet
to the POINT OF BEGINNING.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
