CLOSING AND ABANDONING THE 10 -FOOT WIDE UTILITY EASEMENT IN
LOTS 2 THROUGH 20 AND LOTS 45 THROUGH 63, BLOCK 816A, PORT
ARANSAS CLIFFS SUBDIVISION, SUBJECT TO THE PROVISIONS LISTED
BELOW; AND DECLARING AN EMERGENCY.
WHEREAS, there exists the 10 -foot wide utility easement in Lots 2
through 20 and Lots 45 through 63, Block 816A, Port Aransas Cliffs Subdivision,
recorded in Volume A, Page 27, Map Records of Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon said easement, subject to the
provisions listed below:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the 10 foot wide utility easement in Lots 2 through
20 and Lots 45 through 63, Block 816A, Port Aransas Cliffs Subdivision, as
recorded in Volume A, Page 27, Map Records, Nueces County, Texas, and further
described by metes and bounds, be and the same is hereby closed for public use
and every municipal purpose, providing applicant pay any costs or remove or
reroute the existing water and sanitary sewer lines, Central Power & Light
cables, and pay the $663.38 cost of killing out a gas line which exist in the
easement, and subject to the property being replatted at applicant's expense.
The above described utility easement is hereby abandoned to the owners of the
abutting property in accordance with the laws of the State of Texas, and for the
service and interest of the inhabitants of the City of Corpus Christi, Texas.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance, for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
close and abandon the abovementioned at the earliest practicable date, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances or resolutions at three
regular meetings so that this ordinance is passed and shall take effect upon

County, Texas; all of said lots having been replatted as corresponding
Lots 2 thru 20 and Lots 45 thru 63, Block 816, The Cliffs, a map of
which is recorded in Volume 4, Page 51, Map Records, Nueces County,
Texas; said 10' utility easement is described as being the northwest
5' of Lots 2 thru 20 and southeast 5' of Lots 45 thru 63 in Block 816,
Port Aransas Cliffs by instrument recorded in Volume 488, Page 519,
Deed Records, Nueces County, Texas, said 10' utility easement is
further described by metes and bounds as follows:
Being a strip of land 10.00' wide x 475.00 feet long, 5.00'
on either side of the following described centerline;
BEGINNING at a 5/8" iron rod set for the common easternmost corner
of said Lot 63 and southernmost corner of said lot 2;
Thence N31deg06'00"W along the common southwest boundary line of
said Lots 2 thru 20 and northeast boundary line of said lots 63 thru
45, being a line 125.00' from and parallel to the northeast right-of-
way line of Alameda Street and southwest right-of-way line of Topeka
Street a distance of 475.00' to a 5/8" iron rod found for the common
northernmost corner of said Lot 45 and westernmost corner of said Lot
20 for the ENDING point of the centerline herein described.

or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
