AN ORDINANCE
ACCEPTING THE STATE HIGHWAY AND PUBLIC TRANSPORTATION
COMMISSION'S MINUTE ORDER NO. 85070 PERTAINING TO THE
EXTENSION OF THE CROSSTOWN EXPRESSWAY; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to accept the
State Highway and Public Transportation Commission's Minute Order No. 85070
pertaining to the extension of the Crosstown Expressway, all as more fully set
forth in the Minute Order, a substantial copy of which is attached hereto and
made a part hereof, marked Exhibit "A."
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need of
executing the abovementioned Minute Order at the earliest practicable date, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances or resolutions at three
regular meetings so that this ordinance is passed and shall take, Rffect upon

WHEREAS, in tiUECES COUNTY on STATE HIGHWAY 286 from State Highway 358 to Farm to
Market Road 43, a distance of approximately 3.7 miles, the State Department of
Highways and Public Transportation is preparing plans for improvements; and
WHEREAS, the City of Corpus Christi and Nueces County would have certain
responsibilities in this project;
NOW, THEREFORE, the Engineer -Director is directed to tender the following
proposal to the City of Corpus Christi and Nueces County:
Provided the City and/or County will:
1. Secure all necessary right of way according to the policies of the
State Department of Highways and Public Transportation with
acquisition procedures to be in accordance with applicable Federal and
State laws governing the acquisition policies for acquiring real
property.
2. Provide for any utility adjustments as may be necessary.
The State Department of Highways and Public Transportation will:
1. Proceed with project development through the acquisition of right of
way.
2. Designate State Highway 286 from State Highway 358 to Farm to
Market Road 43, a distance of"approximately 3.7 miles, a CONTROLLED
ACCESS FACILITY for development, maintenance and operation in
accordance with provisions of House Bill 179, 55th Legislature and the
Engineer -Director is directed to be governed accordingly in location,
design, acquisition of right of way, construction, operation and
maintenance of future improvements.
This Order shall become operative upon acceptance by the City of Corpus Christi
and Nueces County and if not accepted within 90 days of the date hereof, the
action herein contained shall be automatically cancelled.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
