HomeMy WebLinkAbout19628 ORD - 02/05/1987AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF NORTON STREET CHURCH OF CHRIST BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OF LOTS 9 AND 10, SECTION 19, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS FROM "F -R" FARM -RURAL DISTRICT TO "A-1" APARTMENT HOUSE DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Norton Street Church of Christ for amendment to the zoning map of the City of Corpus Christi. WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of•Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, February 3, 1987, at regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on a portion out of Lots 9 and 10, Section 19, Flour Bluff and Encinal Farm and Garden Tracts in the City of Corpus Christi, Nueces County, Texas, and further described by metes and bounds below, be changed from "F -R" Farm -Rural District to "A-1" Apartment House District: O1P.108.01 A 10.292 acre tract of land out of Lots 9 and 10, Section 19, Flour Bluff and Encinal Farm and Garden Tracts, as shown on the map in Volume A, at pages 41, 42, and 43, and more particularly described as follows: BEGINNING at a point in the common line between Sections 19 and 27 from which the northeast corner of Lot 9, Section 19, bears North 29°01' East, 338.70 feet; THENCE South 29°O1' West, on the common line of Sections 19 and 27, 338.80 feet; 1962e MICROFILMED THENCE at right angles, North 60°59' West, being at 38.10 feet a 5/8" iron rod in the Northwest right-of-way of County Road No. 9, also known as State Highway No. 357, and Rodd Field Road, at 1285.70 a 5/8" iron rod in the Southeast line of a 75 foot drainage easement the southeast half of same being granted to the County as shown in Volume 780, at page 299, Nueces County Deed Records, and in all 1323.20 feet to the center of said drainage easement, also being the northwest line of Lot 10, Section 19; THENCE North 29°01' East, on the Northwest line of Lot 10, Section 19, and the centerline of said 75 foot drainage easement, 338.80 feet to a point; THENCE at right angles, South 60°59' East, at 37.5 feet a 5/8" iron rod in the Southeast line of said drainage easement, at 1281.6 feet a 5/8" iron rod in the Northwest right-of-way of County Road No. 9, and in all 1323.20 feet to the place of beginning. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passAd and shall take effect upon first reading as an emergency measure this the AW day of diyuketut, , 19 Q7 .
