HomeMy WebLinkAbout19638 ORD - 02/17/1987AN ORDINANCE ORDERING A GENERAL ELECTION TO BE HELD ON APRIL 4, 1987, IN THE CITY OF CORPUS CHRISTI, TEXAS, FOR THE ELECTION OF MAYOR AND EIGHT COUNCIL MEMBERS, ON AMENDMENTS TO THE CHARTER OF THE CITY OF CORPUS CHRISTI AS MORE FULLY SET FORTH ON FILE IN THE OFFICES OF THE CITY SECRETARY AND MADE A PART HEREOF BY REFERENCE AS IF COPIED VERBATIM HEREIN, AND TO ADOPT AN INCREASE IN THE TAX EXEMPTION OF THE RESIDENCE HOMESTEAD FOR INDIVIDUALS WHO ARE DISABLED OR ARE 65 OR OLDER; PROVIDING THAT THE ELECTION BE HELD JOINTLY WITH THE WEST OSO INDEPENDENT SCHOOL DISTRICT TRUSTEES ELECTION AND THE FLOUR BLUFF INDEPENDENT SCHOOL DISTRICT TRUSTEES ELECTION; DESIGNATING POLLING PLACE LOCATIONS; .ENACTING PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. WHEREAS, the City Charter provides for the holding of a regular City election for Mayor and Council members in the City of Corpus Christi, on the first Saturday in April in odd -numbered years, the same being April 4, 1987; and WHEREAS, it is provided by the Election Code of the State of Texas that the governing body shall order elections pertaining to municipal affairs, give notice and appoint election officers to hold the election; and WHEREAS, upon the petition to provide for a homestead exemption of at least 20 percent of the number of qualified voters who voted in the preceding election, the governing body of the City of Corpus Christi shall call an election as provided in Section 11.13 of the Property Tax Code; WHEREAS, the West Oso Independent School District and the Flour Bluff Independent School District have requested that the respective election for Trustees be held jointly with the General Election of the City of Corpus Christi. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a general election for the election of Mayor and Council members, shall be held in the City of Corpus Christi, Texas, on April 4, 1987. SECTION 2. That at said election herein ordered all the qualified voters of the City of Corpus Christi shall be permitted to vote. SECTION 3. The City Secretary, Armando Chapa, whose office is situated at the Office of the City Secretary, Third Floor, City Hall, 302 South Shoreline Drive, Corpus Christi, Texas, is hereby appointed Election Manager and Judge of said election, and is hereby authorized and directed to make all necessary arrangements for the holding of said election in accordance with and subject to the laws of this State. The City Secretary is hereby appointed the Absentee Voting Clerk for the joint absentee voting for the West Oso Independent School District Trustees Election and the Flour Bluff Independent School District Trustees Election. Joint absentee voting shall be conducted at the absentee polling place or places at which the City Secretary regularly conducts absentee voting as provided herein. SECTION 5. Voting machines shall be used for the conduct of said election on election day and for conducting absentee voting, except that for absentee votes cast by mail, paper ballots shall be used. Absentee voting in person shall be conducted in the lobby of City Hall, the same being designated as an extension of the office of the City Secretary, 302 South Shoreline Drive, Corpus Christi, Texas, from 8:00 a.m. to 5:00 p.m., Monday through Saturday, beginning on March 16, 1987, and ending March 31, 1987. The City Secretary shall conduct the absentee voting. SECTION 6. An election is hereby ordered to be held on April 4, 1987 in the City of Corpus Christi, at which election shall be submitted to the voters the amendments described below to the City Charter of the City of Corpus Christi, Texas: Amendment One, City Council Elections, Removal & Recall. Amending'Article II, City Council, to provide for the membership and term of the City Council, general election and run-off election procedures, restrictions on Council members, procedures for removal and impeachment proceedings, procedures for recall petitions and elections, and conform the Charter to the requirements of state and federal laws. [Revises Art. II, Secs. 1-3, 10, 12, 20-25 into new Secs. 1-3, 9, 11, 18-23.] Amendment Two, City Council Procedures. Amending Article II, City Council, to provide for general powers of the Mayor, compensation of the City Council, procedures for filling vacancies and the offices of Mayor and Council members, and regulations concerning the conduct of Council meetings, Council actions, contracts before elections and the involvement of the Council in the administrative affairs of the City. [Revises existing Art. II, Secs. 6-3, 11, 13-19 into new Secs. 6-7, 10, 12-17.] Amendment Three, Administrative Provisions. Amending Article II, City Council, Article III, City Manager, and Article IV, Administration, to provide for the appointment and duties of the City 03P.055.01 Secretary, municipal judges, municipal court clerk, city manager, omitting obsolete provisions on departments and divisions, allowing for the creation of administrative departments and divisions, and establishing a legal department. [Revises existing Art. II, Secs. 26-28, Art. III, Secs. 1-2,'Art. IV, Secs. 1-10, 25-30, 32-38, 40-46, 50-60 and 62 into new Art. II, Secs. 24-25, Art. III, Secs. 1-2, Art. IV, Secs. 1 and 10.] Amendment Four, General Powers and Provisions. Amending Article IV, Administration, and Article IX, General Powers, to allow the City to exercise the powers of a home -rule city under the laws of the State of Texas, to enter into contracts for goods and services, to provide for actions by citizens, to provide for the establishment of assessment and improvement districts and to make general provisions for the rights and powers of the city. [Revises Art. IV, Secs. 14, 39, 47-49, 61, 63, and Art. IX, Secs. 1-37 and 41 into new Art. X, Secs. 1-12.] Amendment Five, Finance, Taxation and Bonds. Amending Article II, City Council, Article IV, Administration, and Article VII, Taxation and Bonds, to provide for independent and internal audit, the adoption of an annual budget, restrictions on fund transfers and the maintenance of accounts, and conforming taxation and bond provisions to the requirements of state law. [Revises existing Art. II, Secs. 29-30, Art. IV, Secs. 11-13, 15-17, 19-20, 24 and Art. VII, Secs. 1-12 into new Art. II, Secs. 26-27, Art IV, Secs. 2-4, 6 and Art. VIII, Secs. 1-2.] Amendment Six, Civil Service and Employment Regulations. Amending Article VI, Employment Regulations, to provide for a classified service defined by the City Council, the powers and duties of the Civil Service Board, and regulations concerning non-discrimination, political activities and candidacies for public office. [Revises Art. VI, Secs. 1-12 into new Art. VII, Secs. 1-5.] Amendment Seven, Boards and Commissions. Amending Article V, Commissions and Boards, to establish a separate article concerning the composition, powers and duties of the Planning Commission, the development and legal effect of the Comprehensive Plan and platting procedures, and to provide general powers for the establishment, terms and duties for boards and commissions, and appeals to the City Council. [Revises Art. V, Secs. 1-15 into new Art. V, Planning, Secs. 1-5, and new Art. VI, Boards and Commissions, Secs. 1-2.] Amendment Eight, Public Utilities, Franchises and Leases. Amending Article VIII, Public Utilities, Franchises and Leases, to provide for the inalienability of public property except under certain conditions, and procedures for the granting, transfer, termination and regulation of franchises 03P.055.01 and leases, the granting of oil and gas leases, the exercise of the power of eminent domain, the operation of public utilities and the sale of untreated water. [Revises Art. VIII, Secs. 1-17 (Exc. 2(c), (d) and (e)) into new Art. IX, Secs. 1-11.] Amendment Nine, Long -Term Leases on the Bayfront. Amending Article VIII, Public Utilities, Franchises and Leases, to delete the exceptions to the referendum requirements on leases of airport property and property owned by other governmental entities and to provide a single exception to the referendum requirements for all properties in city except the submerged lands along the downtown bayfront. [Revises Art. VIII, Secs. 2(c), (d) and (e) into new Art. IX, Sec. 2(b).] Amendment Ten, Initiative and Referendum. Adding a new Section 4 to Article I, to provide procedures for the people of the city to initiate ordinances of the City by petition and election and call for a referendum on repeal of existing ordinances of the City in a similar manner. [Adds Art. I, Sec. 4] Amendment Eleven, Appointment and Removal of Department Heads. Amending Article III, City Manager, to repeal the requirements of Section 3 and 4 thereof, which require the City Council to approve by resolution the appointment or removal of all directors of departments and division heads. [Repeals Art. III, Secs. 3-4.] Amendment Twelve, Annexation. Amending Article I, Incorporation, Annexation and Form of Government, to add limited powers of annexation by ordinance with the requirement for a referendum upon petition by 500 registered voters, and conform the Article to be consistent with state law. [Revises Art. I, Secs. 1-2 and adds subsection 2(d).] The foregoing amendments are set forth in full in the Draft Revised Charter attached hereto as Exhibit A and incorporated herein by reference. The Charter amendment propositions shall appear on the ballot as follows: Proposition One. The ballots for said election on the charter amendments shall be in such form that those voters intending to vote "For" shall show on their ballots a vote "Yes" for the proposition, and those intending to vote "Against" shall show on their ballots a vote "No" for the proposition. SECTION 7. That pursuant to the petition of at least 20 percent of the number of qualified voters who voted in the preceding City election, an election is hereby ordered to grant an exemption in the amount of $50,000 of the appraised value of the residence homestead for an individual who is disabled or is 65 or older. The proposition to be submitted as follows: 03P.055.01 Proposition Thirteen. Shall there be adopted an exemption from ad valorem taxation in the amount of $50,000 of the appraised value of the residence homestead of an individual who is disabled or is 65 or older. The ballots for said election on the adoption of the residence homestead exemption shall be in such form that those voters intending to vote "For" shall show on their ballots a vote "Yes" for the proposition, and those intending to vote "Against" shall show on their ballots a vote "No" for the proposition. SECTION 8. The polls shall be open from 7:00 a.m. to 7:00 p.m., on the date of the said election. SECTION 9. The City Secretary is directed to post and publish such election notices as are required by the Election Code of the State of Texas. SECTION 10. By approving and signing this ordinance, the Mayor officially confirms as his action all matters recited in the ordinance which by law come within his jurisdiction. SECTION 11. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 12. The fact that it is necessary and essential that the governing body of the City of Corpus Christi shall order elections pertaining to municipal affairs and that the notice of such election should be promptly posted and published and that a regular City election for the election of the Mayor and Council members in the City of Corpus Christi shall be held on the first Saturday in April, 1987, and that the requirements of th Federal Voting Rights Act may be timely met, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of , 19 ATT ST: %/7T11-- THE CI' OF CORPUS CHRISTI, TEXAS Ci y ecretary MAYO APPROVED: /7.E./2 DAY OF FX,uary , 1957 HAL GEORGE, CITY ATTORNEY 03P.055.01 Corpus Christi, Texas nfh day of adalwalkt, , 198% TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance or resolution, an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you suspend said Charter rule and pass this ordinance or resolution finally on the date it is introduced, or at the present meeting of the City Council.
