AUTHORIZING THE EXECUTION OF AGREEMENTS WITH YOUTH SPORTS
ORGANIZATIONS FOR FINANCIAL ASSISTANCE THROUGH THE YOUTH
SPORTS ASSISTANCE PROGRAM; APPROPRIATING $100,000; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute
agreements with youth sports organizations for financial assistance through the
Youth Sports Assistance Program whereby matching funds will be provided for
capital improvements to City owned or controlled recreational facilities, all as
more fully set forth in the agreements, copies of which are attached hereto and
made a part hereof marked Exhibits "A," "B," "C," "D," "E," "F," "G", "H," "I,"
J," "K," "L," 'M," "N," and "O."
SECTION 2. That there is hereby appropriated $100,000 from the
No. 551 Park Bond Fund, Youth Sports Assistance Program for granting to youth
sports organizations for capital improvements.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient and effective administration of City affairs by appropriating the
aforementioned amounts, such finding of an emergency is made and declared
requiring suspension of the Charter rule as to consideration and voting upon
ordinances or resolutions at three regular meetings so that this ordinance is
passed and shall take effect upon first reading as an emergency measure this the

This Agreement by and between the City of Corpus Christi, Texas (the
"Grantor") and Westside Pony/Colt League (the "Grantee");
WHEREAS GRANTOR has established a Youth Sports Assistance Program (YSAP) to
provide matching funds for capital improvements to City owned or controlled
recreational facilities;
WHEREAS, the Grantee has been approved to receive a grant of YSAP monies
from Grantor for the improvements and location described on Exhibit A attached
hereto.
NOW, THEREFORE, in consideration of the matching grant provided herein, the
Grantor and the Grantee agree as follows:
Grantee agrees to provide certain improvements to be located on City
property for the benefit and use of the public. The improvements will be in
accordance with applicable City codes and will include the purchase,
installation and construction of amenities as shown on Exhibit A.
Grantor agrees to pay to Grantee the sum set forth on Exhibit A on the
condition that said sum be used to assist the Grantee toward the expenses of the
same. No grant funds will be eligible for any administrative or other recurring
costs.
Grantor shall disburse ten percent (10%) of the total project cost to
Grantee initially and reimburse Grantee based oncosts incurred. Proof of costs
incurred shall be reflected by submittal of payment vouchers to Grantor as
improvements are constructed or upon completion. After the initial 10%
disbursement, Grantee shall be disbursed additional amounts not to exceed the
total grant in amounts equal to two-thirds of costs incurred. Grantor is under
no obligation to grant or reimburse Grantee for expenses or costs which exceed
the initial estimates for the improvements.
Grantor and Grantee shall make a final inspection of improvements to
determine compliance with applicable City codes. Upon completion and acceptance
of the improvements by the City, the improvements shall become the property of
the City.
Grantee agrees to indemnify and forever save harmless the City, its
officers, agents, and employees for any and all lawsuits, claims, damages,
liabilities, losses, and expenses (including court costs, attorney fees, and
expert witness fees) arising out of damage or injuries to any and all persons or

property resulting from or in connection with any activity by Grantee, its
agents, employees, or independent contractors pursuant to the construction or —'—
use of the improvements provided by this Agreement.
Grantee shall purchase and maintain a Comprehensive General Liability
Insurance for a term of five years after installation and acceptance of the
improvements. Minimum limits of coverage shall be $100,000/$300,000 for bodily
injury or death and $50,000 for property damage. The insurance policy shall
name the City of Corpus Christi as additional insured.
Failure to construct the improvements as specified on Exhibit A shall
constitute a breach of the Agreement and may result in the revocation of the
grant provided herein. Upon a breach of this Agreement, Grantor may demand
reimbursement of all funds delivered to Grantee and such other remedies as may
be permitted by law. In the event legal proceedings must be instituted for
enforcement of this Agreement, Grantee agrees to pay court costs and reasonable
attorney fees.
This Agreement may be terminated at any time prior to the disbursement of
any YSAP monies to Grantee. Termination of this Agreement after the 'initial
disbursement shall require the written consent of Grantor and the returnof all
prior disbursements received by Grantee.

This kickball League plans multiple uses for funds allocated under the,,City's
Youth Sports Assistance Program. One of the major projects is that of purchasing
•four sets of aluminum bleachers. Another sizeable League project is that of reno-
vating the press boxes.
Another League project included rebuilding the roofs of the teenage dugouts and
replacing and/or repairing certain minor elements of the chain link fences. Also,
it is proposed to raise two electric scoreboards to prevent annual vandalism in
the.off season, and our application includes concrete to set footings to raise
these two electric scoreboards. Other elements of the League's application include
the request for paint to complete our recently enlarged concession stand project,
as well as the painting of press boxes, dugouts, and other facilities on our playing
fields. The girls' restroom door will be replaced with a new steel door.

include some plumbing work needed, due to vandalism during off season. ,

property for the benefit and use of the public. The improvements will be in
accordance with applicable City codes and will include the purchase,
installation and construction of amenities as shown on Exhibit A.
Grantor agrees to pay to Grantee the sum set forth on Exhibit A on the
condition that said sum be used to assist the Grantee toward the expenses of the
same. No grant funds will be eligible for any administrative or other recurring
costs.
Grantor shall disburse ten percent (10%) of the total project cost to
Grantee initially and reimburse Grantee based on costs incurred. Proof of costs
incurred shall be reflected by submittal of payment vouchers to Grantor as
improvements are constructed or upon completion. After the initial 10%
disbursement, Grantee shall be disbursed additional amounts not to exceed the
total grant in amounts equal to two-thirds of costs incurred. Grantor is under
no obligation to grant or reimburse Grantee for expenses or costs which exceed

Grantor and Grantee shall make a final inspection of improvements to
determine compliance with applicable City codes. Upon completion and acceptance

improvements. Minimum limits of coverage shall be $100,000/$300,000 for bodily
injury or death and $50,000 for property damage. The insurance policy shall
name the City of Corpus Christi as additional insured.
Failure to construct the improvements as. specified on Exhibit A shall
constitute a breach of the Agreement and may result in the revocation of the
grant provided herein. Upon a breach of this Agreement, Grantor may demand
reimbursement of all funds delivered to Grantee and such other remedies as may
be permitted by law. In the event legal proceedings must be instituted for
enforcement of this Agreement, Grantee agrees to pay court costs and reasonable
attorney fees.
This Agreement may be terminated at any time prior to the disbursement of

The scope will include the upgrading of the playing fields. Presently, -
the playing field is about 1.5 feet below the area around it. ' Fill dirt
'will be used to level off the area and at the same time provide for better
drainage. The bleachers are very unstable and we plan to reconstruct them
with cement block on a concrete foundation. The main water line will be
replaced. The backstops are old and rusty. This has put stress on -some
pipes. The scope will provide for the refurbishment of the backstop and
fence as a safety measure.

injury or death and $50,000 for property damage. The insurance policy shall
name the City of Corpus Christi as additional insured.
Failure to construct the improvements as specified on Exhibit A shall
constitute a breach of the Agreement and may result in the revocation of the
grant provided herein. Upon a breach of this Agreement, Grantor maydemand
reimbursement of all funds delivered to Grantee and such other remedies as may
be permitted by law. In the event legal proceedings must be instituted for
enforcement of this Agreement, Grantee agrees to pay court costs and reasonable
