HomeMy WebLinkAbout19643 ORD - 01/29/19870 0 AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 A SUBSECTION SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF LAND DESCRIBED AS A PORTION OUT OF LOTS 19, 20, 21, AND 22, SECTION 6, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Henry Tucker, for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, February 17, 1987, at regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and that permanent zoning of "AB" Professional Office District on Tracts 1 and 3, and "B-1" Neighborhood Business District on Tract 2, more fully described hereinafter, be granted; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That there is hereby amended Article 31 of the Zoning Ordinance, Section 31-5, by adding a new subsection to hereafter read as follows, such zoning classification of the hereinafter described property to be effective upon annexation: 01P.159.01 196'311ICROFILit ED The following described tracts of land shall be zoned and classified as follows: "AB" Professional Office District on the following tract of land: Tract 1 FIELDNOTES for 4.97 acres of land out of Lot 19, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41 thru 43, Map Records of Nueces County, Texas: BEGINNING at a point on the Southwest boundary line of Yorktown Boulevard for the East corner of this tract from which corner the West subdivision corner of Buckingham Estates Unit 1 a map of which is recorded in Volume 48, Pages 37-39, of said Map Records bears South 61°02'00" East 1024.77 feet, thence North 28°58'00" East 120.00 feet; THENCE South 28°58'00" West 379.59 feet for the South corner of this tract; THENCE North 61°02'40" West 570.00 feet to a point on the Southeast boundary line of an existing 130.00 foot wide drainage right-of-way for the West corner of this tract; THENCE North 28056'50" East along said Southeast line, 379.90 feet to a point on the aforementioned Southwest line of Yorktown Boulevard for the North corner of this tract; THENCE South 61°02'00" East along said Southwest line, 570.13 feet to the POINT OF BEGINNING. "B-1" Neighborhood Business District on the following tract of land: Tract 2 FIELDNOTES for a 9.05 acre, more or less, tract of land out of Lots 19 thru 20 and 21, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41 thru 43, Map Records of Nueces County, Texas: BEGINNING at a point on the Southwest boundary line of Yorktown Boulevard (120.00 feet wide) for the East corner of this tract, from which corner the West subdivision corner of Buckingham Estates Unit 1, a map of which is recorded in Volume 48, Pages 37 thru 39, of said Map Records bears North 28°58'00" East 120.00 feet, thence North 61°02'00" West 14.13 feet, more or less; THENCE South 28°58'00" West 379.39 feet, more or less, for the South corner of this tract; 01P.159.01 THENCE North 61°02'40" West 1038.90 feet, more or less, for the West corner of this tract; THENCE North 28°58'00" East 379.59 feet, more or less, to a point on the Southwest boundary line of Yorktown Boulevard for the North corner of this tract; THENCE South 61°02'00" East, along the Southwest boundary line of Yorktown Boulevard, 1038.90 feet, more or less, to the POINT OF BEGINNING. "AB" Professional Office District an the following tract of land: Tract 3 FIELDNOTES for a 3.15 acre, more or less, tract of land out of Lots 21 and 22, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41 thru 43, Map Records of Nueces County, Texas: BEGINNING at a point on the Southwest boundary line of Yorktown Boulevard (120.00 feet wide) for the North corner of this tract, from which corner the West subdivision corner of Buckingham Estates Unit 1, a map of which is recorded in Volume 48, Pages 37 thru 39, of said Map Records bears North 28°58'00" East 120.00 feet, thence North 61°02'00" West 14.13 feet, more or less; THENCE South 61°02'00" East, along the Southwest boundary line of Yorktown Boulevard, 361.10 feet, more or less, for the East corner of this tract; THENCE South 28°58'00" West 379.32 feet, more or less, for the South corner of this tract; THENCE North 61°02'40" West 361.10 feet, more or less, for the West corner of this tract; THENCE North 28°58'00" East 379.39 feet, more or less, to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved of the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. O1P.159.01 SECTION 6.
