FINDING THAT THE PURPOSES OF THE COASTAL BEND HOSPITAL
AUTHORITY HAVE BEEN FULFILLED AND THAT IT IS IN THE BEST
INTEREST OF THE CITY OF CORPUS CHRISTI AND ITS INHABITANTS
THAT THE AUTHORITY BE DISSOLVED; AND PROVIDING FOR A
VOIDANCE OF THIS ORDINANCE IN THE EVENT THAT ANY CLAIM
AGAINST THE AUTHORITY IS PRESENTED SUBSEQUENT TO ENACTMENT
OF THIS ORDINANCE SO THAT THE AUTHORITY SHALL BE
AUTOMATICALLY REINSTATED TO DEFEND SUCH CLAIMS; PROVIDING
FOR SEVERANCE; AND PROVIDING FOR PUBLICATION.
WHEREAS, on October 17, 1979, the City Council of the City of Corpus
Christi passed an ordinance creating the Coastal Bend Hospital Authority
("Authority") under the provisions of the Hospital Authority Act (Chapter 472,
Acts of the 55th Legislature, Regular Session, 1957, codified as Vernon's Ann.
Civ. St. Art. 4437); and
WHEREAS, after due consideration and upon the recommendation of the
Board of Directors of the Authority, the City Council has concluded that the
purposes for which the Authority was formed have been fulfilled and there is no
need for the continued existence of the Authority; and
WHEREAS, the City Council of the City of Corpus Christi now finds that
it is in the interest of the City and its inhabitants to dissolve the Coastal
Bend Hospital Authority;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Council hereby finds that it is in the
interest of the City and its inhabitants to dissolve the Coastal Bend Hospital
Authority.
SECTION 2. That the Authority be hereby dissolved by repeal of
Ordinance No. 15172, enacted October 17, 1979, which Ordinance created the
Coastal Bend Hospital Authority.
SECTION 3. That in the event any claim is presented against the
Coastal Bend Hospital Authority for any act or acts of the Coastal Bend Hospital
Authority, this repealer of Ordinance 15172 shall become automatically void, and
the Coastal Bend Hospital Authority shall be automatically reinstated for the
purpose of defending any and all such claims.
SECTION 4. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance for it is the definite intent of this City

provision hereof be given full force and effect for its purpose.
SECTION 5. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption stating in
substance the purpose of the ordinance, this ordinance to become effective upon
such publication.
