HomeMy WebLinkAbout19649 ORD - 02/17/1987AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH BENNETT, MARTIN AND SOLKA, ARCHITECTS, FOR THE PREPARATION OF PLANS AND SPECIFICATIONS FOR AN APPROXIMATE 2,400 SQUARE FOOT EXPANSION TO LINDALE RECREATION CENTER, REPAIR WORK AT WEST GUTH SWIMMING POOL, AND LIGHTING IMPROVEMENTS AT PRICE FIELD; APPROPRIATING $33,000; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute an agreement with Bennett, Martin and Solka, Architects, for the preparation of plans and specifications for an approximate 2,400 square foot expansion to Lindale Recreation Center, repair work at West Guth Swimming Pool, and lighting improvements at Price Field, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A." SECTION 2. That there is hereby appropriated $33,000 from the No. 551 Park Bond Fund of which $31,000 is for the consultant award and $2,000 is for printing and advertising applicable to Project No. 551-86-2.3, Lindale Recreation Center/West Guth Pool/Price Field Lighting Improvements. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned agreement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall effect upon f'r t read'ng as an emergency measure this the day of , 19V1 ATTEST: Citecretary MAYOR .��// THE CITY OF CORPUS CHRISTI, TEXAS APPROVED:(7lw DAY OF , 19 i% HAL GEORGE, CITY ATTORNEY By Assistant C f i Attorney 03P.057.01 136/MICROFILMED' AGREEMENT FOR ARCHITECTURAL SERVICES THE STATE OF TEXAS 5 COUNTY OF NUECES S The City of Corpus Christi, hereinafter called "City", and Bennett, Martin & Solka, Architects, hereinafter called "Architect", agree as follows: I. SCOPE OF SERVICES The Architect hereby agrees, at his own expense, to perform all architectural, structural, mechanical, electrical, site design work and all related services necessary to properly develop design plans and specifications and to provide general administration of construction for the Lindale Recreation Center Expansion, West Guth Park Swimming Pool Repairs, and Price Softball Field Lighting Replacement as follows: A. Lindale Recreation Center Expansion consisting of an approximate 2,400 square foot social hall expansion for the Lindale Recreation Center, an approximate 350 square foot kitchen to serve the new hall as well as the existing social hall, renovation of the existing offices for supervision, HVAC for the existing game room, additional parking, and upgrading of area lighting throughout the park. B. West Guth Park Swimming Pool Repairs shall include an investigation to ascertain the extent of settlement and, accordingly with available funds, prepare construction documents for the necessary repairs. C. Price Softball Field Lighting which consists of the replacement of the existing field lights with an appropriate lighting system. II. SERVICES TO BE PERFORMED The Architect agrees to perform, for the above required improvements, professional services as hereinafter set forth: A. Preliminary Design Phase 1. The Architect shall hold necessary conferences with the City Staff so as to coordinate the planning and to familiarize himself with the project. 2. Research necessary information applicable to the project with file drawings and other available information of existing facilities being provided by the City. 3. Prepare Preliminary Design Studies and investigations illustrating the scope of the project and submit to the City for approval. 4. Submit a statement of construction cost to the City together with recommendations of most desirable plans. 5. Submit four (4) sets of Preliminary Design Studies and Investigation Report to Engineering Services for review by the City. Agreement - Bennett, Martin & Solka Lindale/West Guth/Price Softball Field Page 1 of 5 B. Construction Documents Phase 1. Prepare, from the approved Preliminary Design documents, the complete working drawings and technical specifications setting forth in detail the requirements for the construction of the project, the conditions of the contract and bid proposal forms. 2. A cost estimate including all alternates, material quantities and unit costs. 3. Submit to Engineering Services three (3) complete sets of the Construction Documents for review by the City. C. Bidding and Contract Phase 1. Upon approval of the Construction Documents by the City, assist in the preparation of the Notice to Bidders as required. 2. Architect will make available to the City, upon request, the original plans and specifications for the purpose of duplicating the bid documents as necessary. 3. Mail or assist in mailing any addenda to the project. 4. Supply the City with twenty-five (25) copies of Bid Tabulation Sheet one day prior to the receipt of bids. 5. Review all bid proposals and prepare a tabulation of the bids. 6. Submit a written recommendation to the City on the award of the contract. In the event the lowest acceptable bid exceeds the estimated cost, the Architect shall confer with the City and make, without any increase in the basic fee, such revisions to the Construction Documents as are satisfactory to the City for the proper adjustment to the construction cost. 7. Within 48 hours of the award of the contract by the City, the Architect shall prepare five (5) copies of the Contract Documents ready for execution by the City and the Contractor. D. Construction Phase 1. Be the City's representative during the construction period which begins with the award of the contract and extends until the final acceptance of the project. 2. Provide the general administration of construction including periodic visits to the site to familiarize himself generally with the progress and quality of the work and to determine, in general, if the work is proceeding in accordance with the contract. The Architect will endeavor to guard the City against defects and deficiencies in the work of contractors, but he does not guarantee the performance of their contracts. 3. Not be required to make exhaustive or continuous on-site inspections normally defined as resident inspection but will make those inspections necessary to certify that, to the best of his knowledge, work has progressed to the point indicated, the quality of the work is in accordance with the construction contract, and the Contractor is entitled to payment. Prepare contractor monthly estimates. Agreement - Bennett, Martin & Solka Lindale/West Guth/Price Softball Field Page 2 of 5 E. As -Built Drawings and Maintenance Manuals 1. The Architect shall furnish to the City, upon completion of said project, or upon termination of this contract as herein provided, a suitable bound copy of the specifications and a reproducible set of mylar or tracing of the working drawings including any and all corrections, revision, alterations, or amendments to the plans and/or specifications made during the Construction Phase so as to reflect the true plans and specifications of the building as built. 2. The Architect shall use 24" x 36" sheet size of 3 mil mylar or tracing for the "as -built" drawings which are to be submitted as described above. 3. The Architect shall furnish to the City, upon project completion, operating manuals or instructions, parts list, or maintenance manuals for all mechanical, electrical, or any other equipment installed on the project. 4. The City will not make final payment to the Architect until the conditions of Paragraph E are met. F. Transfer of Interest The Architect shall not assign or transfer any interest in this contract without prior written consent from the City. G. Orderly Rendering of Services The Architect shall furnish the document required in each phase of the design and personally render or provide the service required in this contract in the sequence and times herein indicated and as may be necessary to insure the prompt and continuous prosecution of the work of designing and constructing the project, and it is understood that all designs and details of designing are subject to the approval of the City, and until the acceptance of results of these services, there shall be no liability on the part of the City for such services. The Architect agrees to furnish items pertaining to Preliminary Design Phase to City within thirty (30) calendar days of authorization to proceed and items required of Construction Documents Phase will be submitted within sixty (60) calendar days of approval of Preliminary Design Phase. H. Cost Estimates The Architect is to provide cost estimates through each phase of the design of the project but does not guarantee the accuracy of such estimates; however, it is understood that the project must be constructed within funds available. The City has $350,000 total funds available for the project, of which $333,000 is allocated for construction cost and Architect's fees. The design of the project shall be that the cost thereof will not exceed the above amounts. Architect will provide City with a budget showing the various elements and costs of the work through the various phases of work. The City will have the right to require the Architect to make revisions to the Construction Documents so as to bring the cost within funds available at no additional fee. Agreement - Bennett, Martin & Solka Lindale/West Guth/Price Softball Field Page 3 of 5 2. Services Furnished by the City 1. The City will furnish survey information for the West Guth Pool Project. The City will further provide survey data at Price Field regarding existing conditions. 2. Soil Reports for the Lindale Recreation Center site will be furnished to the Architect by the City. 3. City will be responsible for the printing cost of final drawings and specifications issued for bidding. III. COMPENSATION A. Professional Fees The City agrees to pay the Architect a fixed fee of Thirty One Thousand Dollars ($31,000.00) for his services in design work and related services as described in Scope of Services. B. Payment Schedule Upon completion of each of the phases outlined in Section II, Paragraphs A through E, and approval and acceptance of same by the City, the City shall pay the following percentages of the fees as previously outlined: 1. Preliminary Design Phase 2. Construction Documents Phase 3. Bidding and Contract Phase 4. Construction Phase Twenty Five Percent (25%) Fifty Percent (50%) Five Percent (5%) Twenty Percent (20%) During the Construction Phase, that percentage of the fee due to Architect may be paid in monthly installments, the amount of which shall bear the same relationship to the twenty percent (20%) as the monthly construction estimate bears to the total contract price. Final payment will not be made to the Architect until the conditions of Section II, Paragraph E. are met. C. Adjustment of Fees In regards to the Architect's fee, the parties further agree; No deductions shall be made from the Architect's fee on account of penalty, liquidated damages, or other sum withheld from payments to the Contractor, but the City will not pay the Architect a fee for change orders necessitated as a result of negligence, errors or omissions on the part of the Architect. IV. CONTRACT TERMINATION The City reserves the right to terminate this contract at any time, with or without cause. In the event of such termination, the Architect will be paid a sum proportionate to the state of completion of the phase of work in which he is then engaged.
