AN ORDINANCE AUTHORIZING EMINENT DOMAIN PROCEEDINGS BY THE CITY TO CONDEMN FEE TITLE TO A PARCELS 3 AND 4 FOR THE BALDWIN FARMS DRAINAGE OUTFALL AND TO ACQUIRE SAID PARCELS FROM THE OWNER, ERNA S. JOHNS; AND DECLARING AN EMERGENCY. WHEREAS, it is necessary to acquire, for an on behalf of the City, certain parcels of land, more fully described hereinafter; and WHEREAS, the Baldwin Farms Drainage Project requires the acquisition of fee simple title in and to the said parcels and acquire said parcel from the Owner; and WHEREAS, the City of Corpus Christi is unable to arrive at an agreement with the said owner and claimant as to the price and value of said tract and damages for the taking thereof by the City; it is, therefore, determined by the City Council that it is necessary that the said parcels be acquired in fee title through the exercise of the City's power of eminent domain for said public purpose; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. In accordance with the City Charter and the laws of the State of Texas, the City of Corpus Christi does hereby order, direct, and authorize that eminent domain proceedings be instituted for the purpose of acquiring the fee simple title of the following described land and premises, excluding mineral interest, for use by the City for the Baldwin Farms Drainage Outfall Project, and for other municipal purposes, within the city limits, and to condemn the fee title to the said parcels of land, excluding mineral interest, said parcel being described by metes and bounds as follows: 03P.074.01 Parcel 3 Being a tract of land out of Lot 4, Block 2, J. C. Russell Farm Blocks as shown by map of record in Volume 28, Pages 58 and 59 and more particularly described by metes and bounds as follows: Beginning at the northeast corner of Lot 4; Thence south along the east line of Lot 4, a distance of 120.0 feet to a point; Thence west along a line that is 120.0 feet south of and parallel to the north line of Lot 4, a distance of 337.07 feet to a point; 196.52 MIC Srii.ii�IEQ Thence south along a line that is 337.07 feet west of and parallel to the east line of Lot 4, a distance of 393.0 feet to a point on the south line of Lot 4; Thence west along the south line of Lot 4, a distance of 120.0 feet to a point; Thence north along a line that is 457.07 feet west of and parallel to the east line of Lot 4, a distance of 513.0 feet to a point on the north line of Lot 4; Thence east along the north line of Lot 4, a distance of 457.07 feet to the point of beginning and containing 2.342 acres, more or less. Parcel 4 Being a 120.0 feet wide strip of land out of Lot 7, Block 2, J.C. Russell Farm Blocks as shown by map of record in Volume 28, Pages 58 and 59, Map Records, Nueces County, Texas, and more particularly described as follows: Beginning at the northeast corner of abovementioned Lot 7; Thence S 4'05'08" E, along the east line of said Lot 7, also being the west right-of-way line of Padre Island Drive, a distance of 17.04 feet to a point; Thence south along the west right-of-way line of Padre Island Drive, a distance of 103.0 feet to a point; Thence west along a line that is 120.0 feet south of and parallel to the north line of said Lot 7, a distance of 1312.79 feet to a point on the west line of said Lot 7; Thence north along the west line of said Lot 7, a distance of 120.0 feet to the northwest corner of said Lot 7; Thence east along the north line of said Lot 7, a distance of 1311.58 feet the point of beginning and containing 3.616 acres, more or less. SECTION 2. The City Attorney is hereby authorized and directed to institute proceedings against the property and against all persons who appear to have an interest therein, and to proceed with said condemnation suit to its final conclusion and to obtain possession and title to said property for use in the aforesaid project and for other municipal purposes. SECTION 3.
