AUTHORIZING THE ACQUISITION OF A UTILITY EASEMENT IN
CONNECTION WITH THE PADRE ISLAND NOS. 1 AND 2 SANITARY
SEWER, PROJECT NO. 250-82-10.1; APPROPRIATING $3,100; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the acquisition of a utility easement in connection
with the Padre Island Nos. 1 and 2 Sanitary Sewer, Project No. 250-82-10.1 is
hereby authorized, all as more fully set forth in the utility easement, a
substantial copy of which is attached hereto and made a part hereof, marked
Exhibit "A."
SECTION 2. That there is hereby appropriated $3,100 from the Sanitary
Sewer Bond Fund.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need of
appropriating the abovementioned funds at the earliest practicable date, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances or resolutions at three
regular meetings so that this ordinance is passed and shall take effect upon
first reading as an19 emergency measure this the .1140 day of

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF NUECES §
THAT
B. J. Blankenship and William S. Perkins
of the County of Nueces, State of Texas, for and in consideration of
the sum of Three Thousand One hundred Dollars and no cents [$3,100.00]
to us in hand paid by the City of Corpus Christi, Nueces County,
Texas, the receipt of which is hereby acknowledged, have granted and
conveyed, and by these presents do grant and convey unto the City of
Corpus Christi, Texas, a municipal corporation duly incorporated under
and by virtue of the laws of the State of Texas, its successors and
legal ,representatives the free and uninterrupted use, liberty,
privilege, and easement of going in, on, over, under and along a
certain tract of land situated in Nueces County, Texas and being
described as follows:

Being all that part of Lot 9b, Block 27, Padre Island No. 1
as recorded in Volume 13, Pages 1-8, Map Records, Nueces
County, Texas and more particularly described as follows:
Beginning at a point on the Westerly line of said Lot 9b,
27.0 feet Southerly of the Northwest corner thereof;
Thence South 83 degrees 49 minutes 33 seconds East, a
distance of 35.13 feet;
Thence South 88 degrees 43 minutes 30 seconds East, a
distance of 115.0 feet to a point on the Easterly line of
said Lot 9b.
Thence South 1 degree 16 minutes 30 seconds West, along the
Easterly line of said Lot 9b, a distance of 10.0 feet;
Thence North 88 degrees 43 minutes 30 seconds West, a
distance of 150 feet to a point on the Westerly line of said
Lot 9b;
Thence North 1 degree 16 minutes 30- seconds East, a distance
of 13.0 feet to the point of beginning and containing
1,552.5 square feet or 0.0356 acres, more or less.
Together with a 20 foot wide temporary construction easement
north of and adjacent to the permanent easement. Said
temporary construction easement to be used for working room
and storage of materials during construction phase. Said
temporary construction easement to be abandoned upon
completion of project and ground area to be restored to as
was or better condition.

A map marked "Exhibit A", is attached hereto and made a part
hereof for all purposes.
Together with the free ingress, egress, and regress to and for
the City of Corpus Christi, Texas, for the purpose of constructing,
laying, and keeping public utility lines, and for the purposes of
maintaining, servicing, repairing, and inspecting said lines under,
on, and along said tract.
OWNERS SHALL HAVE THE RIGHT TO UTILIZE THE UTILITY EASEMENT FOR
THE INSTALLATION OF UNDERGROUND STORAGE TANKS SO LONG AS THE HORIZONAL
SEPERATION BETWEEN THE SANITARY SEWERLINE AND THE UNDERGROUND TANKS IS
3.0 FEET. THE INSTALLATION OF THE UNDERGROUND TANKS SHALL BE
CONDUCTED IN SUCH A MANNER THAT THE SANITARY SEWER IS NOT DISTURBED.
TO HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges
aforesaid to the City of Corpus Christi, Texas its successors and
legal representatives, for the proper use as a UTILITY
EASEMENT and utility right-of-way for so long as used
for such purpose, and if the use for said easement and way of said
uses be ever abandoned, then in that event, the aforesaid rights and
privileges shall cease.
