AUTHORIZING THE EXECUTION OF A CONTRACT WITH THE CONSULTANT
FIRM OF ESPEY, HUSTON AND ASSOCIATES, INC., AND BECHTOL,
HOFFPAUIR ANPEHRLER, INC. TO PROVIDE A MASTER PLAN FOR THE
JOHN F. KENNEDY CAUSEWAY RECREATION AREA; APPROPRIATING
$65,000; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute a
contract with the consultant firm of Espey, Huston and Associates, Inc., and
Bechtol, Hoffpauir and Ehrler, Inc. to provide a master plan for the John F.
Kennedy Causeway Recreation Area, all as more fully set forth in the contract, a
substantial copy of which is attached hereto and made a part hereof, marked
Exhibit "A."
SECTION 2. That there is hereby appropriated $65,000 from the No. 111
Trust Fund, Project No. 111-243.37.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need of
executing the abovementioned contract at the earliest practicable date, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances or resolutions at three
regular meetings so that this ordinance is passed and shall take effect upon

MASTER PLAN STUDY

The City of Corpus Christi, hereinafter called "City" and Espey, Huston & Associates,
Inc., together with Bechtol, Hoffpauir and Ehrler, Inc., engineering and environ-
mental consultants hereinafter called "Consultants", agree as follows:
That Consultants shall provide a Master Plan for the John F. Kennedy Causeway
Recreation Area and hereby agree to perform all necessary tasks and services to
assure the successful development of recreational and commercial activities and
facilities. The City shall pay Consultants Sixty-five Thousand Dollars ($65,000)
-upon approval of the Master Plan by the City of Corpus Christi. Consultants shall
perform services as described.
I.
Land Characterization:
Consists of collecting data for the purposes of conducting an essential charac-
terization of the proposed study area. This task will include, but not necessarily
be limited to, the following for the study area; reflected in Exhibit "A", attached,
and made a part hereof:
o Current physical description and conditions
o Environmental/Regulatory restraints relevant to
- submerged grass areas
- oyster reefs
- navigational areas
- rookery areas
- archaeological concerns
- other areas of state/federal concern
o Utility service - on site
o Access to utilities
- water
- wastewater
- power
- gas
o Easements, i.e., mineral interest holders (channels and pipelines) utility
companies, navigation districts, etc.

o Easements, i.e., private use"of'pieiis» channels, structures
o Leases, i.e., vendors, bait camp operators, marinas, oil and gas well locations
o Federally authorized activities, i.e., Gulf Intracoastal Waterway, spoil disposal

o Surrounding land use characteristics

II.
Public, Private & Lessee and Easement Holder Notification:
From the data collected under section I., the Consultants will prepare a listing of
all parties and interests involved or potentially affected by the subsequent Master
Plan Design. Meetings will be held with the City of Corpus Christi, Texas General
Land Office and the Consultants to review the listing referenced above, refined such
and prepare notification letters. =- - -
The purpose of this task will be to:
(A) Identify key representatives from each "interest holder group" in the study
(B) Provide notification to each representative as to the intended scope of work.
(C) Obtain relevant "land interest" documents and data to accurately ascertain
property rights and authorized activities.
(D) Insure proper and timely coordination of interested parties in conjunction with
the Master Plan Design.
Data Analysis:
After the Consultants complete the data collection and land characterization effort
described under Section I, they will then analyze this information and prepare land -
use maps. This will be aerial photographs with a series of overlays depicting
current use, utilities, regulatory restraints, sensitive areas, etc. From this task,
the following will be derived: -

o Baseline land inventory
o Environmental/Regulatory restraints analysis
o Utility locations
o Guidance for various land -use options for the Piaster Plan
o Predictability for future State and City -related use
o Accountability for State and City decisions
o Cost-effective planning
o Flexible data base
Iv.
Revenue Analysis:

This task will focus on data collected from Sections I and II to analyze monetary
impacts and restraints on state revenues, existing public/private partnerships,
vendor contracts, and leases. First, Consultants will provide a comprehensive review
of all such documents and arrangements that provide revenue to the State of Texas,
Nueces County, and the City of Corpus Christi within, and if needed, adjacent to the
project site. Second, this review will compare current and projected economic
conditions with lessee and vendor monetary contractual arrangements. Finally, this
information will be integrated into the various scenarios developed in the Master
Plan as such would purport to affect revenues.
During task numbers delineated in Section V and VI, a revenue analysis will again be
conducted and integrated into the master Plan to ensure the maximization of monies
expected to be derived from proposed vendor contracts, leases, and public/private
partnerships. The Consultants have the ability to conduct complete analysis of
population trends including historical growth or decline by various population
components, proposed large-scale developments in the vicinity, changes in demographic
characteristics, population movements and changes in area distribution and
socioeconomic characteristics. Using this analysis, economic conditions can be
forecasted for the area by using computerized methodologies to isolate trends for
various activities such as public/private partnership, vendor activities, and leases
within the study area. All of this information will be used in development of the
Master Plan relevant to economic returns from compatible activities.
Finally, a study of the relation between amenity values and submerged land uses will
be conducted. The study will correlate pairs of uses: the value of a use with an
amenity will be paired with the value of that same use without an amenity.
The correlation study will validate amenity percentage and will determine the value
of an amenity to particular uses.
The consultant will utilize the General Land Office Submerged Land formula (RF = Q x
AFMV x V x ROR) and develop supporting documentation by examining 4 to 6 components
each for 2 amenity categories to aid in the validation of this process.
The amenity categories involved in the effort are: (1) Waterfront property adjacent
to a channel and (2) Waterfront property with a pier in support of a commercial
establishment.
This effort will result. in documentation for determining submerged land amenity
values for adjacent waterfront property amenity values.

V.
Recreation Activities Study:

Existing and future,recreational activities of the area for local and tourist usage
will be the basis for the research and analysis needed to form design and planning
objectives for the area pursuant to this task.
This problem presented is one of land use compatibility: will the proposed and
existing commercial development, in conjunction with existing and proposed recre-
ational developments on the John F. Kennedy Causeway, generate immediate effects,
such as traffic noise, and visual impacts, which are likely to create unacceptable
conditions for the continued economic development of the Causeway Corridor. The City
of Corpus Christi's mandate further indicates that the question of land use compati-
bility should be addressed in the context of the broader economic and environmental
effects of°multiple use (commercial -and recreational)'as compared with single (recre-
ationalonly) use of the Causeway Corridor. -Consultants shall consider and respond
to needs :and concerns _expressed by the .State Department of Highways and Public
Transportation concerning the highway facility. .,.
Because of .the complexity and speculative nature of the long-term economic and
environmental effects of multiple use, this study will focus on more immediate,
quantifiable.effects of specific proposed .and existing developments. In support of
the ultimate findings and recommendations of the study, however,..the more subjective
long-term issues of land compatibility, including the "highest and best use" of the
proposed and existing recreational and/or commercial sites, will also be addressed.
VI.
Master Plan Development:
Consultants shall produce a 'phased Master Plan of the Causeway Corridor which will
identify -and recommend approaches to resolve.conflioting jurisdictional issues __
''and provide the -necessary planning -guidelines to assure -the successful development
of recreational and commercial activities and facilities. This will be presented in
a form compatible with existing and proposed commercial and recreational- activities
throughout the Causeway Corridor.
Following the land use compatibility analysis the Consultant Team will establish a
range of probable development scenarios and standards that will be acceptable to the
cumulative levels of development calculated and proposed for the Master Plan. The
Master Plan also reviews the results of the compatibility and economic analysis in
light of broader. planning issues, such as highest and best use, aesthetics (land-
scaping), user perceptions and secondary development. The Plan concludes with a
summary of findings;`graphic displays and an Implementation Plan augmented by a
series of recommendations necessary for a timely implementation. Further, due to the
Consultants' existing knowledge of the area, users, lessees contractual arrangements
with the State and City and overlapping jurisdictions, it can already be acknowledged
that proper management and implementation ensuring maximum monetary return can best
be achieved through a "Master Lessee" concept. It is understood that City and the
Texas General Land Office will serve as Co -administrators of such a Master Lease.
This concept will be a guiding factor•throughout all phases of the project concluding
in the recommendations and plan design of Section VI.

VII.
Purchased Services and Photography:

Consultant shall provide the necessary photographic work required to identify
existing resources and land -use needs. The photography shall include overlays
depicting current use, utilities, regulatory restraints and sensitive areas.
VIII.
Additional Services:
In addition to the basic planning program previously described, Consultants shall
provide supplemental information as required, including but not limited to: atten-
dance at monthly review meetings in Corpus Christi with the City Staff and re-
presentatives of the Texas General Land Office and the State Department of Highways
and Public Transportation; presentation of the preliminary plan to the Park and
Recreation Board and the City Council; the State Department of Highways and Public
Transportation, and the Texas General Land Office; attendance at public meetings and
revision of initial studies as necessary; design of facilities, structures, or
printing of master plan reports. Consultants shall provide thirty (30) copies of
reports to City. Any copies over thirty (30) will be billed to City at cost value.
IX.
TERM:
Consultants shall complete all work under this contract within six (6) months upon
execution of contract, and in accordance with the following schedule for delivery of
documents to City: Section I and III, Section II, Section IV, Section V, and Section
VI.
X.
Fee For Basic Services:
The fee for performing the Basic Planning Services will be as follows:
The City will pay the Consultants a maximum of Sixty Five Thousand Dollars ($65,000)
providing for all services in this contract as depicted in Attachment 1, attached,
and made a part hereof. This fee will be full and total compensation for all
services outlined in this Contract including additional work which may be added by
change order to existing contracted work provided that change order is in keeping
with the original scope of work and is normal and incidental to the types of services
proposed.
XI.
Partial Payments:
Consultants shall file with the Park and Recreation Department monthly and on
completion of each document called for in Section XV, reports of money and man-hours
expended by the Consultants relative to this contract. Upon submission of said
documents and/or progress reports 1-6, approved by City, consultants may request
partial payment and City shall make partial payments in accordance with the following

(1) Consultants will not on the grounds of age, handicap, sex, race, color or
national origin, discriminate or permit discrimination against any person or
group of persons in any manner.
(2).. The Consultants agree to._refrain from any unlawful employment practices as .to
comply.with all lawfully adopted regulations relating thereto.= -
(3) Consultants agree to indemnify and forever save harmless the City, its.officers,
_agents, and employees for any and all.. lawsuits, claims, damages, -liabilities,
losses, and expenses.(including-court costs, attorneys fee,_and expert .witness
fees) for or_ on account 'of any_ injury to .any person, or death at any time
resulting from such injury, or damage to or in connection with any activity by
Consultants, its agents, employees, or independent contractors pursuant to this
Agreement.
XIII.
Termination of Contract:
The City may, at any time, with or without cause, terminate this contract upon prior
written notice to Consultants at the address of record. In the event, the Consult-
ants shall be compensated for his services on all stages authorized as follows:
(A) If termination occurs prior to the final completion and approval of the Master
•Plan, the_Consultants shall be paid a reasonable compensation for the services
actually rendered in proportion to the amount of work done.
(8) The foregoing shall not be construed to require the City to compensate the
Consultant for any services not performed in a proper professional manner
suitable for use of the Master' Plan contemplated by the •parties to this
Contract.
XIV.
Consultants' Liability:
Acceptance and approval of the final plan by the City shall not constitute nor be
deemed a release of the responsibility and liability of the Consultants, its em-
ployees, associates, agents and consultants, for the accuracy and competence of their
designs, working drawings, and specifications or other documents and work,'nor shall
such approval be deemed to be an assumption of such responsibility by the City for
any defect in designs, working drawings,. and specifications. or .other, documents
prepared by the Consultants, its employees, subcontractors, agents and consultants.

XV.
Submittal of Documents:

Consultants shall furnish individual reports to City of Section I and III, Section
II, Section IV, Section V, and Section VI in said order, upon completion of the
respective studies. Within fourteen (14) days of the execution of this contract,
Consultant shall submit a time schedule for submittal of said sections reports.
XVI.
Ownership of Documents:
Upon completion of the plan the Consultants shall furnish to the City, in a suitable
container for City's Ownership, tracing or mylar design drawings, together with a
correct and legible set of specifications; not to be reproduced by Consultant unless
approved by City. Master Plan may be used as a Marketing Document by Consultants.
XVII.
Assignability:
Consultants shall not assign, transfer or delegate any obligations or duties in this
Contract to any other person without the prior written consent of the City, except
for routine duties delegated to personnel of the Consultants' Staff. If Consultants
is a partnership, in the event of the termination of the partnership, this Contract
shall insure to the individual benefit of such partner or partners as the City may
designate. No part of the Consultants' fee may be assigned in advance of receipt by
the Consultant without written consent of the City.
XVIII.
Technical Assistance and Consultations:
The City shall not pay the fees of expert or technical assistance and consultants.
Consultants shall be responsible for any such technical assistance and consultations.
XIX.
Disclosure of Interests:
Consultants further agree, in compliance with City of Corpus Christi Ordinance No.
17112, to complete, as part of this Contract, the Disclosure of Interests form
attached hereto.

ATTACHMENT
The boundary of the study area begins at an upland area that consists
of both city and county property on either side of South Padre Island at the
entrance to the JFK Causeway then continues 3000 feet either side of the
centerline of South Padre Island Drive going east from Flour Bluff. The study
area continues to the Intracoastal Waterway to land fall. The boundary of
the study area at that point follows the ROW of Park Road 22 south to the
intersection of Access Road No. 4 where the boundary runs east to the water's
edge. The boundary then turns north to include a strip of Gulf land between
the seawall and the water's edge up to Packery Channel. At this point the
boundary turns westward to Park Roads 22 and 53 intersection and northward
up Packery Channel around Nueces County Park ending at Park Road 22 ROW and
the eastern edge of the JFK Causeway.
