HomeMy WebLinkAbout19687 ORD - 03/31/1987AN ORDINANCE AUTHORIZING THE EXECUTION OF A MEMORANDUM OF UNDERSTANDING BETWEEN THE NATIONAL PARK SERVICE AND THE CITY OF CORPUS CHRISTI FOR PROVISION OF A TOURIST INFORMATION CENTER TO BE LOCATED IN THE NATIONAL SEASHORE OFFICE AT 9405 S. PADRE ISLAND DRIVE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute a memorandum of understanding between the National Park Service and the City of Corpus Christi for provision of a Tourist Information Center to be located in the National Seashore Office at 9405 S. Padre Island Drive, for a term of five years, terminable upon 60 days notice, with no monetary payment by the City, all as more fully set forth in the memorandum of understanding, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A." SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned memorandum of understanding at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall takg effect upon first 'rela9din as an emergency measure this the al day of ATTEST: /a„.,9 City Secretary MAYOR THE CITY OF CORPUS CHRISTI, TEXAS APPROVED: 31 DAY OF %vI ci vc IN , 19 SV7 HAL GEORGE, CITY ATTORNEY By yj�/ A3syss an't City Atto} i ey 04P.059.01 36MICROFILMED Agreement No.--- MEMORANDUM OF UNDERSTANDING BETWEEN NATIONAL PARK SERVICE AND CITY OF CORPUS CHRISTI, TEXAS Article I WHEREAS, Padre Island National Seashore, hereinafter called Seashore, does not have the manpower to provide full tourist information dissemination at the Seashore Office located at 9405 S. Padre Island Drive and is desirous of having such tourist information available; and WHEREAS, the City of Corpus Christi, hereinafter called City, has a active tourist information program operated through the Corpus Christi Area Tourist and Convention Bureau and is desirous of operating a tourist information center in Flour Bluff in conjunction with the Seashore Office; and WHEREAS, the Seashore Office has adequate space which can be provided for tourist information dissemination and the City, acting through the Corpus Christi Area Tourist and Convention Bureau, can provide both manpower and material for dissemination; and WHEREAS, the Seashore may enter into an agreement based on authority found in 43 USC Sec. 1363. Article II Statement of Work NOW, THEREFORE, City and Seashore agree as follows: 1. The Seashore will provide mutually agreed adequate space in the Seashore Office at 9405 S. Padre Island Drive for a tourist information center. 2. The City will cause the Corpus Christi Area Tourist and Convention Bureau to,provide personnel and materials to operate the Center. Article III Term of Agreement This Memorandum of Understanding will run for a period of five (5) years unless previously cancelled under provisions of Article VIII. At the end of the term, the Memorandum of Understanding may be re -affirmed for an additional lease period by prior approval of both parties. Article IV The authorizing official for the Seashore is the Superintendent. The authorizing official for the City is the City Manager, as designated by the City Council. Article V Property Utilization 1. The Seashore shall provide mutually agreeable space in the Seashore Office during mutually agreeable times during the week (it is presently projected that the tourist information center would be in operation seven (7) days per week). 2. The personnel and volunteers provided through the Corpus Christi Area Tourist and Convention Bureau will use due diligence in protecting the Seashore Office. Article VI Prior Approval No prior approval is designated as no financial obligation will be incurred by the Seashore. Article VII Reports No reports are required of the City under this agreement nor from the Seashore. It is anticipated that the Corpus Christi Area Tourist and Convention Bureau will provide period reports on numbers of visitors serviced to both the City and Seashore. Article VIII, Termination This Memorandum of Understanding may be terminated by either party by providing sixty (60) days written notice to the other. Padre Island Drive Corpus Christi, TX 78418 Article IX Administrative Clauses During the performance of this agreement, the participants agree to abide by the terms of Executive Order 11246 on non-discrimination and will not discriminate against any person because of race, color, religion, sex or national origin. The participants will take affirmative action to ensure that applicants are employed without regard to their race, color, religion, sex or national origin. No member or delegate to Congress, or resident Commissioner, shall be admitted to share any part of this agreement, or to any benefit that may arise therefrom but this provision shall not be construed to extend to this agreement . if made with a corporation for its general benefit.
