HomeMy WebLinkAbout19688 ORD - 03/25/1987AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF PJC PARTNERSHIP BY GRANTING A SPECIAL COUNCIL PERMIT FOR AN EMPLOYEE PARKING LOT ON A PORTION OF LOT 1, BLOCK 1, THE CROSSROADS SHOPPING VILLAGE; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of PJC Partnership, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, March 31, 1987, at regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on a portion of Lot 1, Block 1, The Crossroads Shopping Village, situated in the City of Corpus Christi, Nueces County, Texas, and further described by metes and bounds below, for an employee parking lot, according to the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A", and subject to all other considerations of "R -1B" One -family Dwelling District: 04P.038.01 DESCRIBING a 0.1550 acre tract, more or less, out of Lot 1, Block 1, The Crossroads Shopping Village, as shown on Plat of Record in Volume 52, Page 174, Nueces County Plat Records, Nueces County, Texas, being more particularly described by metes and bounds as follows: BEGINNING at a point on the east R.O.W. line of 50 foot wide Dorthy Street, the northwest corner of said Lot 1, Block 1, The Crossroads Shopping Village, for the northwest corner of this tract; THENCE S 87°14'00" E with the north line of said Lot 1, Block 1, a distance of 135.00 feet to an exterior corner of said Lot 1, Block 1, for the northeast corner of this tract; i9eFs MICROFILMED THENCE S 02°46'00" W, at 10.00 feet pass an interior corner of said Lot 1, Block 1, a distance in all of 50.00 feet to a point for the southeast corner of this tract; THENCE N 87°14'00" W a distance of 137.00 feet, more or less, to a point on said east R.O.W. line of 50 feet wide Dorthy Street, for the southwest corner of this tract; THENCE in a northerly direction with said east R.O.W line of Dorthy Street (a circular curve to the left, having a central angle of 24°09'42", a radius of 700.00 feet, a tangent of 149.82', a total length of 295.19 feet) an arc distance of 47.00 feet more or less, to the point of termination of said curve, for a corner; THENCE N 02°46'00" E continuing with said east R.O.W. line of 50.00 foot wide Dorthy Street, a distance of 3.00 feet to the POINT OF BEGINNING. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall tA�k__e effect upon first reading as an emergency measure this the 4( day of i\/Vi kCik_) , L9.61 .
