HomeMy WebLinkAbout19694 ORD - 04/06/1987AN ORDINANCE CALLING A RUNOFF ELECTION FOR MAYOR AND TWO (2) COUNCIL MEMBERS IN THE CITY OF CORPUS CHRISTI, TEXAS, TO BE HELD ON THE 18TH DAY OF APRIL, 1987; DESIGNATING POLLING PLACE LOCATIONS FOR SUCH ELECTION; ENACTING PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. WHEREAS, the City Charter provides for the holding of a regular City election for Mayor and eight (8) Council Members in the City of Corpus Christi on the first Saturday in April in odd -numbered years, the same being April 4, 1987; WHEREAS, it is provided in the Texas Election Code of the State of Texas (1985) that the governing bodies shall order elections pertaining to municipal affairs, give notice upon the election of officers to hold the election; WHEREAS, the Election Code requires runoff elections in the event that any candidate for Mayor or Council Member fails to receive a majority of all votes case for such office at any regular municipal election, at which runoff election the two candidates receiving the highest number of votes for such office in the first election shall again be subject to a vote of the qualified voters; WHEREAS, Article II, Section 3, of the City Charter sets runoff election for the second Saturday following the regular election; and WHEREAS, the official canvass of the election returns of the regular election duly held for the office of Mayor and Council Members has been duly had in accordance with State law and City Charter requirements, and inasmuch as none of the candidates for the office of Mayor and none of the candidates for office of Council Member in District 1 and District 5 received a majority of all votes cast at said regular election, held on April 4, 1987, for such office, there is hereby declared a necessity for a runoff election. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a runoff election for the election of Mayor and two (2) Council Members in District 1 and District 5 in the City of Corpus Christi, shall be held in the City of Corpus Christi on April 18, 1987, with the names of the following candidates for the respective office as follows: MAYOR: COUNCIL MEMBER DISTRICT 1: 04P.084.01 Betty Turner Tony Bonilla Rudy Sosa Frank Mendez 1-€z-9-4 MICROFILMED COUNCIL MEMBER DISTRICT 5: Sally Madalin Bill Pruet SECTION 2. That at said election herein ordered all the qualified voters of the City of Corpus Christi shall be permitted to vote. SECTION 3. That the names of candidates for the office of Mayor and the names of candidates for the office of the City Council Members shall be placed on said ballot in the manner and form prescribed by law. SECTION 4. That voting machines shall be employed at the election herein ordered in accordance with the provisions of the Election Code, and said election shall be held at the polling places in the regularly prescribed precincts of the City of Corpus Christi, such voting precincts and polling places, being as follows: 04P.084.01 Said election shall be held in accordance with the election laws of the State of Texas. The polls shall be open from 7:00 a.m. to 7:00 p.m., on the date of the said election. SECTION 5. The City Secretary, Armando Chapa, whose office is situated at the office of the City Secretary, Third Floor, City Hall, 302 South Shoreline Drive, Corpus Christi, Texas, is hereby appointed Election Manager and Judge of said election, as amended, and is hereby authorized and directed to make all necessary arrangements for the holding of said election in accordance with and subject to the laws of this State. SECTION 6. Voting machines shall be used for the conduct of said election on election day and for conducting absentee voting, except that for absentee votes cast by mail, paper ballots shall be used. Absentee voting in person shall be conducted in the lobby of City Hall, the same being designated as an extension of the office of the City Secretary, 302 South Shoreline Drive, Corpus Christi, Texas from 8:00 a.m. to 5:00 p.m. Monday through Saturday, beginning on Wednesday, April 8, 1987, and ending on Tuesday, April 14, 1987. The City Secretary shall conduct the absentee voting. SECTION 7. The Absentee Ballot Board is hereby created to process absentee voting results, and Bruce Aycock is hereby appointed as Presiding Judge, to serve as Presiding Judge for this election. The Presiding Judge is a resident, qualified elector of the City. The Presiding Judge shall appoint at least two other members of such Board. Ireneo Saenz, Rosalie Garza and Charlotte Sutton are hereby appointed Deputy City Secretaries to conduct absentee voting. SECTION 8. The City Secretary is directed to post and publish such election notices as are required by the Election Code of the State of Texas. SECTION 9. By approving and signing this ordinance, the Mayor officially confirms as his action all matters recited in the ordinance which by law come within his jurisdiction. SECTION 10. That it is hereby officially found and determined that the meeting at which this Ordinance was adopted and said election was called was open to the public and public notice of the time, place, and purpose of said meeting was given, all as required by Vernon's Annotated Civil Statutes, Article 6252-17, as amended. SECTION 11. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 12. The necessity of ordering a runoff election immediately to meet the requirements of State law and the City Charter creates a public 04P.084.01 emergency requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency exists, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDING SO ORDAINED, this the day of April, 1987.
