HomeMy WebLinkAbout19705 ORD - 03/31/1987AN ORDINANCE CLOSING AND ABANDONING A 30 -FOOT LONG BY 1 -FOOT WIDE PORTION OF THE 5 -FOOT WIDE UTILITY EASEMENT IN LOT 34, BLOCK 9, CRESTMONT SUBDIVISION UNIT 7, SUBJECT TO THE PROVISIONS LISTED BELOW; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 30 -foot long by 1 -foot wide portion of the 5 -foot wide utility easement in Lot 34, Block 9, Crestmont Subdivision Unit 7, recorded in Volume 49, Pages 64 and 65, Map Records of Nueces County, Texas; and WHEREAS, it has to the City of Corpus provisions listed below: NOW, THEREFORE, CORPUS CHRISTI, TEXAS: SECTION 1. That a 30 -foot long by 1 -foot wide portion of the 5 -foot wide utility easement in Lot 34, Block 9, Crestmont Subdivision Unit 7, as recorded in Volume 49, Pages 64 and 65, further described by metes and bounds attached, be and the same is hereby closed for public use and every municipal purpose, subject to the property being replatted at applicant's expense. The above described utility easement is hereby abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas. been determined that it is feasible and advantageous Christi to abandon said easement, subject to the BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to close and abandon the abovementioned utility easement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall tae effect upon lfirstf reading as an emergency measure this the 1141 day of pr City Secretary APPROVED/S DAY OF)'/Ldt., 19 gi HAL GEO13GE, CITY ATTORNEY MAYOR THE CITY OF CORPUS CHRISTI, TEXAS 19'osMICROFILMED FIELDNOTES for the closing of a portion of a 5.00 foot wide utility easement out of Lot 34, Block 9, Crestmont Unit 7, a map of which is recorded in Volume 49, Pages 64 and 65, Map Records of Nueces County, Texas: BEGINNING at a point on the South boundary line of said 5.00 foot wide utility easement for the Southeast corner of said easement to be closed, from which corner the Northeast corner of said Lot 34 bears South 61°31'10" East 20.40 feet, thence North 27°50'39" East 5.00 feet; THENCE North 61°31'10" West, along the South boundary line of said utility easement, 14.25 feet to the point of curvature of a circular curve to the left whose radius point bears South 28°28'50" West 169.50 feet and which has a central angle of 05°17'39", a radius of 169.50 feet, a tangent distance of 7.84 feet and an arc length of 15.66 feet; THENCE, with said curve to the left, continuing along the South boundary line of said utility easement, 15.66 feet for the Southwest corner of this easement to be closed; _ THENCE North 27°50'39" East 1.34 feet for the Northwest corner of said easement to be closed; THENCE South 62°09'21" East 29.90 feet for the Northeast corner of said easement to be closed; THENCE South 27°50'39" West 0.95 feet to the POINT OF BEGINNING.
