HomeMy WebLinkAbout19709 ORD - 04/14/1987AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF LUIS GONZALEZ BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OF LOT 7, SECTION 9, BOHEMIAN COLONY LANDS FROM "R-2" MULTIPLE DWELLING DISTRICT TO "A -IA" APARTMENT HOUSE DISTRICT WITH A SPECIAL PERMIT FOR A PROFESSIONAL OFFICE TO BE LOCATED WITHIN THE APARTMENT COMPLEX FOR THE APPLICANT'S USE ONLY AND WITH THE CONDITION THAT IF HE VACATES THE OFFICE, THE OFFICE SHALL REVERT TO APARTMENT USE; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Luis Gonzalez for amendment to the zoning map of the City of Corpus Christi. WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, April 14, 1987, at regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF. THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on a portion of Lot 7, Section 9, Bohemian Colony Lands in the City of Corpus Christi, Nueces County, Texas, and further described by metes and bounds below, be changed from "R-2" Multiple Dwelling District to "A -1A" Apartment House District with a special permit for a professional office to be located within the apartment complex for the applicant's use only and with the condition that if he vacates the office, the office shall revert to apartment use, according to the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A," and subject to all other considerations of "A -1A" Apartment House District: FIELDNOTES for an 0.86 acre (37,489 square foot) tract of land out of Lot 7, Section 9, Bohemian Colony Lands, a map 04P.052.01 19705 MICROFILMED of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas: BEGINNING at a 5/8 inch iron rod found for the South corner of this survey, same being the West corner of Lot 28, Block 6, Crestmont Unit 2, a map of which is recorded in Volume 42, Pages 130 and 131 of said Map Records; THENCE North 61°30'00" West at 275.20 feet pass 5/8 inch iron set on line in all a distance of 295.20 feet to a point on the Southeast boundary line of Kostoryz Road for the West corner of this survey; THENCE North 28°59'00" East, along said Southeast boundary line, parallel to its centerline and 20.00 feet distant therefrom, measured at right angles thereto, 127.00 feet for the North corner of this survey; THENCE South 61°30'00" East at 20.00 feet pass a 5/8 inch iron rod set on line in all a distance of 295.20 feet to a point on the Northwest boundary line of Lot 29, Block 6, of said Crestmont Unit 2 for the East corner of this survey; THENCE South 28°59'00" West, along the Northwest boundary line of said Lots 28 and 29, Block 6, a distance of 127.00 feet to the POINT OF BEGINNING. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and 04P.052.01 shall take effect upon first reading as an emergency measure this the 10'1 day of � /Mil. , 19n .
