CLOSING AND ABANDONING FOUR 10 -FOOT WIDE UTILITY EASEMENTS
IN PORTIONS OF BLOCKS 1 AND 2, CRESTMONT SUBDIVISION,
UNIT 10, SUBJECT TO THE PROVISIONS LISTED BELOW; AND
DECLARING AN EMERGENCY.
WHEREAS, there exists four 10 -foot wide utility easements in portions
of Blocks 1 and 2, Crestmont Subdivision Unit 10, recorded in Volume 51,
Pages 67 and 68, Map Records of Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon said easement, subject to the
provisions listed below:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That four 10 -foot wide utility easements in portions of
Blocks 1 and 2, Crestmont Subdivision Unit 10, as recorded in Volume 51,
Pages 67 and 68, and shown and described by attached maps and metes and bounds
descriptions, be and the same is hereby closed for public use and every
municipal purpose, providing applicant pay relocation costs for the existing
Central Power & Light and gas lines therein and subject to the property being
replatted at applicant's expense. The above described utility easement is
hereby abandoned to the owners of the abutting property in accordance with the
laws of the State of Texas, and for the service and interest of the inhabitants
of the City of Corpus Christi, Texas.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance, for it is the -definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
close and abandon the abovementioned utility easements at the earliest
practicable date, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances or

BEGINNING at a point on the West boundary line of Persimmon Drive (60.00 feet
wide) for the Northeast corner of this easement from which corner a 5/8 inch iron rod
set for the Northeast corner of said Lot 6 and the Southeast corner of Lot 7 bears
South 28°30'00" West 5.00 feet;
THENCE South 28°30'00" West, along the West boundary line of Persimmon Drive
at 5.00 feet pass said 5/8 inch iron rod set for the common corner of said Lots
6 and 7, in all a distance of 10.00 feet for the Southeast corner of this easement;
THENCE North 61°30'00" West, parallel to the common boundary line of said Lots
6 and 7, a distance of 92.50 feet to a point on the East boundary line of an existing
7.50 foot wide utility easement as shown on said map of Crestmont Unit IOR for the
Southwest corner of this easement;
THENCE North 28°30'00" East, along the Southeast boundary line of said existing
utility easement, at 5.00 feet pass the common boundary line of said Lots 6 and 7,
in all a distance of 10.00 feet for the Northwest corner of this easement;
THENCE South 61°30'00" East, parallel to the common boundary line of said Lots
6 and 7, a distance of 92.50 feet to the POINT OF BEGINNING.

BEGINNING at the Northwest corner of this easement from which corner a 5/8 inch
iron rod set for the North corner of said Lot 4 and the South corner of said Lot 5
bears South 28°30'00" West 5.16 feet, thence North 75°29'54" West 7.48 feet;
THENCE South 75°29'54" East parallel to the common boundary line of said Lots
4 and 5, a distance of 75.30 feet, fortthe Northeast corner of this easement and the beginning
of a circular curve to the left whose radius point bears South 69°45'36" East 50.00
feet and which has a central angle of 11°28'36", a radius of 50.00 feet, a tangent
distance of 5.02 feet, and an arc length of 10.02 feet;
THENCE, with said circular curve to the left, along the boundary'line of
Persimmon Drive, 10.02 feet for the Southeast corner of this easement;
