HomeMy WebLinkAbout19715 ORD - 03/27/1987AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF CITY OF CORPUS CHRISTI By GRANTING A SPECIAL COUNCIL PERMIT FOR SIGNAGE ON A PORTION OF LOT 1, BLOCK 1, THE CROSSROADS SHOPPING VILLAGE; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of City of Corpus Christi, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, April 14, 1987, at regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on a portion of Lot 1, Block 1, The Crossroads Shopping Village, situated in the City of Corpus Christi, Nueces County, Texas, and further described by metes and bounds below, for signage, according to the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A," and subject to all other considerations of "B-1" Neighborhood Business District: DESCRIBING a 2.585 acre tract out of Lot 1, Block 1, The Crossroads Shopping Village, as shown on Plat of Record in Volume 52, Page 174, Nueces County Plat Records, Nueces County, Texas, being more particularly described by metes and bounds as follows: 04P.050.01 BEGINNING at a point on the west R.O.W. line of 80.00 foot wide Airline Road, the northeast corner of said Lot 1, Block 1, The Crossroads Shopping Village, for the northeast corner of this tract; THENCE S 02°46'00" W along said west R.O.W. line of 80.00 foot wide Airline Road, a distance of 410.50 feet to a point 19715 MICROFILMED (the beginning of a curve to the right whose central angle = 116°34'00", radius = 41.23 feet, tangent = 66.71 feet, length = 83.88 feet) for a corner; THENCE in a southwesterly direction with said curve to the right, an arc distance of 83.88 feet to its point of termination on the north R.O.W. line of 60.00 foot wide McArdle Road for a corner; THENCE N 60°40'00" W along said north R.O.W. line, a distance of 287.84 feet to a point (the beginning of a curve to the right whose central angle = 87°35'42", radius = 30.00 feet, tangent = 28.77 feet, length = 45.86 feet) for a corner; THENCE in a northeasterly direction with said curve to the right, an arc distance of 45.86 feet to its point of termination on the east R.O.W. line of 50.00 foot wide Dorthy Street for a corner; THENCE in a northerly direction with said east R.O.W. line of 50.00 foot wide Dorthy Street (a circular curve to the left whose central angle - 24°09'42", radius = 700.00 feet, tangent = 149.82 feet, length = 295.19 feet) an arc distance of 248.15 feet, more or less, to a point, the northwest corner of Lot 1A, Block 1, Koolside Addition, as shown on Plat of Record in Volume 44, Page 105, Nueces County Plat Records, Nueces County, Texas, for the northwest corner of this tract; THENCE S 87°14'00" E with the north line of said Lot 1A, Block 1, Koolside Addition, a distance of 136.58 feet, to a point, an interior corner of said Lot 1A, Block 1, Koolside Addition, for an interior corner of this tract; THENCE N 02°46'00" E with a line common to original Lots 6, 7, 26, and 27, Block 1, Koolside Addition, as shown on Plat of Record in Volume 13, Page 33, Nueces County Plat Records, Nueces County, Texas, a distance of 40.00 feet, to a point, an interior corner of said Lot 1, Block 1, The Crossroads Shopping Village, and the northwesterly exterior corner of this tract; THENCE S 87°14'00" E with the north line of said Lot 1, Block 1, The Crossroads Shopping Village, a distance of 135.00 feet to the POINT OF BEGINNING. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. 04P.050.01 SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall ake. effect upon first reading as an emergency measure this the 2-1A)day of n ?7.
