AGREEING TO TO THE CITY'S CONSTRUCTION OF FEDERAL -AID
TRAFFIC SIGNAL SAFETY IMPROVEMENTS; AND DECLARING AN
EMERGENCY.
WHEREAS, the State Department of Highways and Public Transportation in
1985 contracted for traffic signal improvements at the intersection of Kostoryz
Road/McArdle Road; and
WHEREAS, traffic signal safety improvements under this program are
financed primarily by federal -aid safety improvement funds, with the City
providing a 10 percent match of total construction cost; and
WHEREAS, the construction of improvements at the Kostoryz/McArdle
intersection was undertaken prior to the April 1986 bond election which provided
funds to improve McArdle Road between Ayers Street and Carroll Lane; and
WHEREAS, it was determined that it would not be feasible to have the
State's contractor complete this project since the planned widening of both
McArdle Road and Kostoryz Road would require the reconstruction of all
contract -installed traffic signal improvements; and
WHEREAS, the State has agreed to stop work and to have its contractor
turn all purchased traffic signal equipment and materials over to the City for
installation, using other than federal -aid funds, within five years specifying
that the City will be required to reimburse the State the federal -aid portion of
the total project cost if this time limit is not satisfied; and
WHEREAS, provisions have been made in the McArdle Road Construction
Project plans for performing a certain amount of the traffic signal improvement
construction work at a cost of approximately $12,000; and
WHEREAS, City crews will then install the remaining hardware to
complete the traffic signal improvements coincident with the completion of the
McArdle Road Construction Project;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City hereby agrees to construct federal -aid
traffic signal safety improvements at the intersection of Kostoryz Road/McArdle
Road with the following conditions:
1. That new traffic signal control equipment and materials, valued at
$19,253 will be furnished to the City for this project.
2. That the improvements will be completed within five years.

3. That failure by the City to construct the improvements within five
years would require the City to reimburse the State Department of
Highways and Public Transportation the federal -aid portion of the
total project cost.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient and effective administration of City affairs, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to
consideration and voting upon ordinances or resolutions at three regular
meetings so that this resolution is passed and shall take effect upon first
reading as an emergency measure this the day of , 19

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
