HomeMy WebLinkAbout19756 ORD - 05/12/1987AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF NUECES COUNTY, TEXAS, BY GRANTING A SPECIAL COUNCIL PERMIT FOR A MINIMUM SECURITY JAIL IN 22,000 SQUARE FEET OF THE WILLIAM McKENZIE NUECES COUNTY COURTHOUSE ANNEX WITH RELATED OUTSIDE AREA FOR PARKING, A DROP-OFF POINT, AND EXERCISE AREA, ON A PORTION OF LOT 1, BLOCK 15, AIRPORT INDUSTRIAL PARK; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Nueces County, Texas, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, May 26, 1987, at regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on a portion of Lot 1, Block 15, Airport Industrial Park, situated in the City of Corpus Christi, Nueces County, Texas, and further described by metes and bounds below, for a 192 bed low risk minimum security jail, which will meet all State law requirements for this type facility, in 22,000 square feet of the William McKenzie Nueces County Courthouse Annex with related outside area for parking, a drop-off point, and exercise area, according to the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A", and subject to all other considerations of "I-2" Light Industrial District: DESCRIBING an area of Lot 1, Block 15 which is on record Records, Nueces described by metes 05P.054.01 of 64,305 square feet, more or less, out , Airport Industrial Subdivision, a map of in Volume 35, Page 143, Nueces County Map County, Texas, and more particularly and bounds as follows: 19756 MICROFILMED COMMENCING at a point, the southeast corner of said Lot 1, Block 15, Airport Subdivision; THENCE in a westerly direction with the south boundary line of said Lot 1, Block 15, a distance of 367.00 feet more or less to its intersection with the southerly extension of the east wall of an existing structure, commonly referred to as the William McKenzie Nueces County Courthouse Annex. THENCE in a northerly direction, with said east wall and its extension, a distance of 160.00 feet, more or less, to the POINT OF BEGINNING; THENCE continuing in a northerly direction with said east wall, a distance of 29.82 feet, more or less, to a point for a corner; THENCE in a westerly direction with a line perpendicular to the aforementioned east wall, a distance of 52.68 feet more or less, to a point for a corner; THENCE in a northerly direction with a line perpendicular to the previously mentioned line, a distance of 12.00 feet, more or less, to a point for a corner; THENCE in a westerly direction with a line perpendicular to the previously mentioned line, a distance of 45.58 feet more or less, to a point for a corner; THENCE in a northerly direction with a line perpendicular to the previously mentioned line, a distance of 72.71 feet, more or less, to a point for a corner; THENCE in a westerly direction with a line the previously mentioned line, a distance more or less, to a point for a corner; THENCE in a northerly direction with a line the previously mentioned line, a distance more or less, to a point for a corner; perpendicular to of 21.56 feet, perpendicular to of 90.47 feet, THENCE in a westerly direction with a line perpendicular to the previously mentioned line, a distance of 5.42 feet, more or less, to a point for a corner; THENCE in a northerly direction with a line perpendicular to the previously mentioned line, a distance of 58.50 feet, more or less, to a point for a corner; 05P.054.01 THENCE in an easterly direction with a line perpendicular to the previously mentioned line, a distance of 63.24 feet, more or less, to a point for a corner; THENCE in a southerly direction with a line perpendicular to the previously mentioned line, a distance of 7.5 feet, more or less, to a point for a corner; THENCE in an easterly direction with a line perpendicular to the previously mentioned line, a distance of 13.5 feet, more or less, to a point for a corner; THENCE in a southerly direction, with a line perpendicular to the previously mentioned line, a distance of 5.0 feet, more or less, to a point for a corner; THENCE in a easterly direction with a line the previously mentioned line, a distance more or less, to a point for a corner; THENCE in a southerly direction with a line the previously mentioned line, a distance more or less, to a point for a corner; THENCE in a westerly direction with a line the previously mentioned line, a distance more or less, to the POINT OF BEGINNING. perpendicular to of 213.00 feet, perpendicular to of 251.00 feet, perpendicular to of 164.50 feet, In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and 05P.054.01 shall �ake effect upon first reading as an emergency measure this the a% day ofp_ , 19 g' .
