CLOSING AND ABANDONING PORTIONS OF THE 100 -FOOT WIDE
WHITECAP BOULEVARD BETWEEN TORTUGAS AVENUE AND WINDWARD
DRIVE; PROVIDING FOR REPLATTING, DEDICATION OF REALIGNED
RIGHT-OF-WAY, CITY ACCEPTANCE OF THE REALIGNED RIGHT-OF-WAY
IMPROVEMENTS, AND REMOVAL OF THE STREET IMPROVEMENTS IN THE
OLD ALIGNMENT; AND DECLARING AN EMERGENCY.
WHEREAS, notice of the time and place for holding a hearing concerning
the closing of portions of the 100 -foot wide Whitecap Boulevard between Tortugas
Avenue and Windward Drive, was given by publication and mailed to the last known
addresses of the owners of property abutting the public way and within 450 feet
of the area proposed to be closed, and thereafter, pursuant to said notice,
public hearing was held at the regular Council Meeting by the City Council of
the City of Corpus Christi on October 2$, 1986, in accordance with the
provisions of the City Charter; and
WHEREAS, it was determined by the City Council after such hearing that
the aforesaid portion of right-of-way, proposed to be closed, is not needed now,
nor will they be within the foreseeable future needed as public rights-of-way,
and that the same should revert to the abutting property owners, subject to
certain specified conditions:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby closed and abandoned portions of
100 -foot wide Whitecap Boulevard between Tortugas Avenue and Windward Drive,
as shown by plat in Volume 1106, Page 516, Map Records, Nueces County, Texas,
and described by the metes and bounds which are attached hereto and made a part
hereof, marked Exhibit "A," subject to replatting, dedication of realigned
right-of-way, City acceptance of the realigned right-of-way improvements, and
removal of the street improvements in the old alignment.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
close and abandon the abovementioned public right-of-way at the earliest
practicable date, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances at
three regular meetings so that this ordinance is pas 1 and shall take effect
upo�nn irst reading as an emergency measure this the day of

METES AND BOUNDS DESCRIPTION FOR THE
CLOSURE OF PORTIONS OF WHITECAP BOULEVARD
BEING TRACTS I AND II BEING PORTIONS OF LAND 100 FEET IN WIDTH
DESCRIBED AS PARCEL B IN VOLUME 1106, PG. 516 DEED RECORDS OF
NUECES COUNTY, TEXAS, AND BEING MORE PARTICULARLY DESCRIBED AS
FOLLOWS:
TRACT 1
Being 0.18 acres of land more or less, out of a portion of
Whitecap Boulevard as shown on attached Exhibit A and being more
particularly described by metes and bounds as follows:
COMMENCING at the southwest corner of Lot 2, Block 40,
Padre Island No.1, recorded in Vol. 43, Pages 47-49 of
the Nueces County Map Records, said point being the
intersection of the north right of way line of the 100
feet wide Whitecap Boulevard and east right of way line
of the 60 feet wide Tortugas Ave.;
THENCE south 88° 43' 30" east, 218.98 feet, along said
north R.O.W. of Whitecap Boulevard to the point of
BEGINNING of this tract;
THENCE south 88° 43' 30" east, 293.52 feet, along the
north boundary line of Whitecap Boulevard.
THENCE south 1° 16' 30" west, 50.08 feet, to the
beginning of a curve to the righ, having a radius of
10.00 feet, a central angle of 107 6' 28", a distance
of 18.69 feet to the beginning of a curve to the left;
THENCE, alogg said curve to the left having a central
angle of 10 50' 23", a radius of 1518.44 feet, a
distance of 287.27 feet to the point of beginning and
containing 0.18 acres of land, more or less.

Being 3.53 acres of land out of a portion of Whitecap Boulevard
as shown on attached Exhibit A and being more particularly
described by metes and bounds as follows:
COMMENCING at the intersection of the north right of
way line of the 100 feet wide Whitecap Boulevard and
the east right of way line of 65 feet wide Cane Harbor
Boulevard; •as recorded in Volume 49 , Pg. 5 & 6 of the
Nueces Couhty Map Records;
THENCE south 88° 43' 30" east, 1013.96 feet, along the
north boundary line of Whitecap Boulevard to a corner
of this tract;
THENCE north 1° 16' 30" east, 40 feet, to the beginning
of a curve to the right;
THENCE along Aaid curve to the right having a central
angle of 10 00' 00", $ radius of 939.40 feet, a
tangent bearing of south 88 43' 30" east, a distance
of 163.96 feet to the beginning of a curve to the left;
THENCE along said curve to the le't having a radius of
143.00 feet, a central angle of 29 29' 14", a distance
of 73.59 feet to the beginning of a curve to the right;
THENCE along said curve to the ri�ht having a radius of
50.00 feet, a central angle of 91 33' 50", a distance
of 79.90 feet to a corner of this tract;
THENCE south 88° 43' 30" east, 134.41 feet, to the
northeast corner of this tract;
THENCE south 1° 16' 30" west, 100.00 feet, along the
east boundary line to the southeast corner of this
tract;

south boundary line of Whitecap Boulevard to the
beginning of a curve to the left;
THENCE along said curve to the left having a radius of
1518.44 feet, a central angle of 1 9' 5", a tangent
bearing of north 67° 03' 50" west, a distance of 30.52
feet to the beginning of a curve to the right;
THENCE along said curve to the right having a radius of
10.00 feet, a central angle 69° 28' 25", a distance of
12.13 feet to a corner;

THENCE north 10 16' 30" east, 79.52 feet, along the
west boundary line of this tract to the point of
beginning, and containing 3.53 acres of land, more or
less.

and pass this odinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
