AUTHORIZING EMINENT DOMAIN PROCEEDINGS BY THE CITY TO
CONDEMN FEE TITLE TO -A DRAINAGE—EASEMENT AND A TEMPORARY
CONSTRUCTION EASEMENT FOR THE BLANCHE-MOORE DRAINAGE OUTFALL
PROJECT_ AND TO_ACQUIRE_ SAID EASEMENTS FROM THE OWNER, JOHN
ZERR.
WHEREAS, it is necessary to acquire, for an on behalf of the City,
a drainage easement and a temporary construction easement, more fully described
hereinafter; and
WHEREAS, the Blanche Moore Drainage Outfall Project requires the
acquisition of fee simple title in and to the said easements and acquire said
easements from the owner, John Zerr; and
WHEREAS, the City of Corpus Christi is unable to arrive at an
agreement with the said owner and claimant as to the price and value of said
easements and damages for the taking thereof by the City; it is, therefore,
determined by the City Council that it is necessary that the said easements be
acquired in fee title through the exercise of the City's power of eminent domain
for said public purpose;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. In accordance with the City Charter and the laws of the
State of Texas, the City of Corpus Christi does hereby order, direct and
authorize that eminent domain proceedings be instituted for the purpose of
acquiring the fee simple title of the following described land and premises,
excluding mineral interest, for use by the City for the Blanche Moore Drainage
OOtfall Project, and for other municipal purposes, within the city limits, and
to condemn the fee title to the said easements, excluding mineral interest, said
parcel being described by metes and bounds as follows:

DRAINAGE EASEMENT
FIELDNOTES for a 10.00 foot wide drainage easement out of
Lot 2a, Block 1, Ridgewood Unit 4, a map of which is
recorded in Volume 51, Page 95, Map Records of Nueces
County, Texas:
BEGINNING at a point on the Southwest boundary line of
Burnham Drive for the North corner of this easement, from
which corner the East corner of Lot 3, said Block 1, and the
North corner of said Lot 2a, Block 1, bears North 61°00'30"
West 5.00 feet;
THENCE South 61°00'30" East, along the Southwest boundary
line of said Burnham Drive, 10.00 feet for the East corner
of this easement;
THENCE South 28°59'30" West 247.50 feet to a point on the
common boundary line of said Lot 2a and an existing 75.00
foot wide City of Corpus Christi drainage right-of-way for.
the South corner of this easement;

THENCE North 61°00'30" West, along said common boundary
line, 10.00 feet for the West corner --of this easement;
THENCE North 28°59'30" East, parallel to the common boundary
line of said Lots 2a and 3 and 5.00 feet distant therefrom,
measured at right angles thereto, 247.50 feet to the POINT
OF BEGINNING.
TEMPORARY CONSTRUCTION EASEMENT
FIELDNOTES for a 25.00 foot wide temporary construction
easement out of Lot 2a, Block 1, Ridgewood Unit 4, a map of
which is recorded in Volume 51, Page 95, Map Records of
Nueces County, Texas:
BEGINNING at a point on the Southwest boundary line of
Burnham Drive for the North corner of this easement, from
which corner the East corner of Lot 3, said Block 1, and the
North corner of said Lot 2a, Block 1, bears North 61°00'30"
West 15.00 feet;
THENCE South 61°00'30" East, along the Southwest boundary
line of said Burnham Drive, 25.00 feet for the East corner
of this easement;
THENCE South 28°59'30" West 247.50 feet to a point on the
common boundary line of said Lot 2a and an existing 75.00
foot wide City of Corpus Christi drainage right-of-way for
the South corner of this easement;
THENCE North 61°00'30" West, along said common boundary
line, 25.00 feet for the West corner of this easement;
THENCE North 28°59'30" East, parallel to the common boundary
line of said Lots 2a and 3 and 15.00 feet distant therefrom,
measured at right angles thereto, 247.50 feet to the POINT
OF BEGINNING.
SECTION 2. The City Attorney is hereby authorized and directed to
institute proceedings against the property and against all persons who appear to
have an interest therein, and to proceed with said condemnation suit to its
final conclusion and to obtain possession and title to said property for use in
the aforesaid project and for other municipal purposes.
