ANNEXING A 133.43 ACRE TRACT OF LAND OUT OF LOTS 18-21,
27-31, SECTION 21, AND OUT OF LOTS 5-7, SECTION 22, FLOUR
BLUFF AND ENCINAL FARM AND GARDEN TRACTS WHICH IS THE
PRESENT LOCATION OF BILL WITT PARK; AND DECLARING AN
EMERGENCY.
WHEREAS, on June 8, 1987, and June 9, 1987, public hearings were duly
held following publication of due notice of said hearing in the official
newspaper, pursuant to Article 970a, V.A.C.S., Texas, as amended, for the
consideration of institution of proceedings for the annexation of defined area
wholly within the extraterritorial jurisdiction of the City of Corpus Christi,
more particularly described by metes and bounds as hereinafter set forth, at
which all interested persons were afforded an opportunity to be heard, and by
motion duly made, seconded and carried the said hearing was closed June 9, 1987;
and
WHEREAS, it has been determined by the City Council that the territory
within said tract or parcel of land, now proposed to be annexed, abuts and is
contiguous and adjacent to the City of Corpus Christi and constitutes lands and
territories subject to contractual annexation ,as provided by the City Charter
Article I, Section 2c; and
WHEREAS, it has been determined that it would be advantageous to the
City and to its citizens and in the public interest to annex the aforesaid lands
and territory hereinafter described:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the tract or parcel of land as described by metes and
bounds below, is hereby annexed:
Describing a 133.43 acre tract of land more or less out of
Lots 18, 19, 20, 21, 27, 28, 29, 30, and 31, Section 21, and
Lots 5, 6, 7, Section 22, Flour Bluff and Encinal Farm and
Garden Tracts, as shown by map of record in Volume A,
Pages 41, 42, and 43, Map Records, Nueces County, Texas, and
being a portion of the original Rodd Field acquired by the
United States of America in Civil Action No. 91, in the
District Court of the United States for the Southern
District of Texas, Corpus Christi Division, judgment for
which is found recorded in Volume 263, Page 22, Deed
Records, Nueces County, Texas, said 133.43 acre tract being
more particularly described by metes and bounds as follows:
Commencing at the intersection of the centerline of 110'
wide Yorktown Boulevard and the northeasterly extension of

the present city limit line as established by Ordinance
No. 19667, dated March 10, 1987, same city limit being a
distance of 773.91 from the centerline intersection of 40'
wide County Road 13 (Cimmaron Road) and 110' wide Yorktown
Boulevard, thence S. 29°03'25" W., a distance of 40' to an
existing corner of the aforementioned city limit line, in
all a distance of 50' for the point of beginning, and the
northern most corner of this tract herein described.
THENCE S. 61°17'30" E., along south R.O.W. line of 110' wide
Yorktown Boulevard and being 50' from and parallel to
centerline of Yorktown Boulevard, a distance of 2,432.68'
more or less, to a 1" iron pipe, for the most easterly
corner of this tract;
THENCE S. 28°30'15" W., with a line that is 16.7 feet
southeast of an 8 foot high hurricane type wire fence, at
501.10 feet pass a 1" iron pipe, at 651.06 feet pass an iron
spike, in all a distance of 979.12 feet to a 60 penny nail
in asphalt, 16.1 feet east of said 8 foot high hurricane
type wire fence for an interior corner of the tract herein
described;
THENCE S. 2°20' E., at 1,425.97 feet pass a drill hole, at
1,620.73 feet pass a 1" iron pipe that is 0.20 feet east, at
1,932.97 feet pass a 1" iron pipe, in all a distance of
2,236.57 feet to a 1" iron pipe for the southeast corner of
the tract herein described;
THENCE S. 87°42'00" W., with a line that is 2 feet south of
an 8 foot high hurricane type wire fence, a distance of
794.74 feet to a 1/2" iron rod in concrete for the southwest
corner of the tract herein described;
THENCE N. 2°20' W., with a line that is 2 feet west of an 8
foot high hurricane type wire fence, at 303.60 feet pass a
drill hole, at 810.6 feet pass a drill hole at 1,308.4 feet
cross said fence running west, in all a distance of 1,415.30
feet to a 1/2" iron rod in concrete for an interior corner
of the tract herein described;
THENCE N. 47°19'00" W., a distance of 2,244.95 feet to a 1"
iron pipe for the most westerly corner of the tract herein
described;
THENCE N. 28°42'30" E., a distance of 1374.85' more or less,
to a point on a line, the present city limit line
established by Ordinance No. 19667, dated March 10, 1987,
this line also being the present northwest boundary of Rodd
Field Park.

THENCE N. 29°03'25" E., a distance of 185.15' more or less,
along the present aforementioned city limit line, also being
the present northwest boundary of Rodd Field Park, to a
point on the south R.O.W. line of 110' wide Yorktown
Boulevard, a 1" iron pipe, for the most northerly corner of
this tract and point of beginning.
The above described area shall hereafter be a part of the City of
Corpus Christi, Texas, and shall be subject to the general laws of the State of
Texas, the City Charter, and the ordinances, resolutions, motions, laws, rules
and regulations of the City of Corpus Christi, to all intents and purposes as
the present City of Corpus Christi is so subject, and subject to all the rights,
privileges and burdens thereof.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance, for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient and effective administration of City affairs by annexing the
heretofore described tract of land at the earliest practicable date, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances at three regular meetings so
that this ordinance is passed and shall take effect upon first reading as an

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
