CLOSING AND ABANDONING A 10 -FOOT LONG BY 50 -FOOT WIDE
PORTION OF STREET RIGHT-OF-WAY ADJACENT TO NILE DRIVE,
SUBJECT TO THE PROVISIONS BELOW; AND DECLARING AN EMERGENCY.
WHEREAS, notice of the time and place for holding a hearing concerning
the closing of a 10 -foot long by 50 -foot wide portion of street right-of-way
adjacent to Nile Drive, was given by publication and mailed to the last known
addresses of the owners of property abutting the public way and within 450 feet
of the area proposed to be closed, and thereafter, pursuant to said notice,
public hearing was held at regular Council Meeting by the City Council of the
City of Corpus Christi on May 12, 1987, in accordance with the provisions of the
City Charter; and
WHEREAS, it was determined by the City Council after such hearing that
the aforesaid portion of right-of-way, proposed to be closed, is not needed now,
nor will they be within the foreseeable future needed as public rights-of-way,
and that the same should revert to the abutting property owners, subject to
certain specified conditions:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby closed and abandoned a 10 -foot long
by 50 -foot wide portion of street right-of-way adjacent to Nile Drive, as shown
by plat in Volume 31, Page 51, Map Records, Nueces County, Texas, and described
by the metes and bounds which are attached hereto and made a part hereof, marked
Exhibit "A," providing for payment by the applicant of the fair market value of
the right-of-way in the amount of $765.00, providing applicant remove the
existing street improvements and construct curb and gutter across the open
portion, and providing for replatting at applicant's expense.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
close and abandon the abovementioned portion of street right-of-way at the
earliest practicable date, such finding of an emergency is made and declared
requiring suspension of the Charter rule as to consideration and voting upon
ordinances at three regular meetings so that this ordinance is passed and shall
take effect upon first reading as an emergency measure this the /V -day of

BEGINNING at a point on the Northwest boundary line of Nile Drive (60.00 feet
side) for the South corner of this tract and the point of curvature of a circular

28°58'40" East 10.00 feet and which has a central angle of 89°55'00" a radius of
10.00 feet, a tangent distance of 9.99 feet and an arc length of 15.70 feet;
THENCE, with said circular curve to the left, 15.70 feet to a point on the
Northwest boundary line of Nile Drive, for the East corner of this tract;
THENCE South 29°03'40" West, parallel to the centerline of Nile Drive and 30.00
feet distant therefrom, measured at right angles thereto, 70.00 feet to the POINT
OF BEGINNING.

or resolution, an emergency exists requiring suspension of the Charter rule

and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
