HomeMy WebLinkAbout19884 RES - 07/28/1987A RESOLUTION AUTHORIZING EMINENT DOMAIN PROCEEDINGS BY THE CITY TO CONDEMN FEE TITLE TO A PARCEL OF LAND FOR THE I.H. 37/ U.S. 77 INTERCHANGE IMPROVEMENTS PROJECT AND TO ACQUIRE SAID PARCEL FROM THE OWNER, ELSIE B. GREENWOOD. WHEREAS, it is necessary to acquire, for and on behalf of the City, a certain parcel of land, more fully described hereinafter; and WHEREAS, the I.H. 37/U.S. 77 Interchange Improvements Project requires the acquisition of fee simple title in and to the said parcel and to acquire said parcel from the owner, Elsie B. Greenwood; and WHEREAS, the City of Corpus Christi is unable to arrive at an agreement with the said owner and claimant as to the price and value of said parcel and damages for the taking thereof by the City; it is, therefore, determined by the City Council that it is necessary that the said parcel to be acquired in fee title through the exercise of the City's power of eminent domain for said public purpose; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. In accordance with the City Charter and the laws of the State of Texas, the City of Corpus Christi does hereby order, direct and authorize that eminent domain proceedings be instituted for the purpose of acquiring the fee simple title of the following described land and premises, excluding mineral interest, for use by the City for the I.H. 37/U.S. 77 Interchange Improvements Project, and for other municipal purposes, within the city limits, and to condemn the fee title to the said parcel of land, excluding mineral interest, said parcel being described by metes and bounds as follows: BEING 0.0287 acres of land, more or less, out of Gregorio Farias Grant, Abstract No. 592, in Nueces County, Texas, and being a part of the same land described in a deed recorded in Volume 355, Page 421, of the Deed Records of Nueces County, Texas; said 0.0287 acres of land, more or less, being more particularly described by metes and bounds as follows: 06P.057.01 BEGINNING at the northeast corner of the Tract as described above; THENCE, S 14°09'30" E, a distance of 20.00 feet along the easterly line of said tract; THENCE, S 75°50'30" W, a distance of 62.48 feet; 19884 MICROFILMED THENCE, in a northerly direction along a curve to the right along the proposed east right-of-way line of I.H. 37, a distance of 20.00 feet to a point; said curve having a radius of 1392.39 feet, an internal angle of 0°49'22" and an initial tangent bearing of N 14°58'52" W; THENCE, N 75°50'30" E, a distance of 62.62 feet along the south line of East Redbird Lane, as now established, to the point of beginning and containing an area of 0.0287 acres of land, more or less. SECTION 2. The City Attorney is. hereby authorized and directed to institute proceedings against the property and against all persons who appear to have an interest therein, and to proceed "with said condemnation suit to its final conclusion and to obtain possession and title to said property for use in the aforesaid project and for other municipal purposes.
