AMENDING CHAPTER IV, ENTITLED IDENTIFICATION AND INVENTORY,
OF THE PRESERVATION PLAN ADOPTED PURSUANT TO SECTION 28A-6
OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI;
PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the Preservation Plan, Chapter IV, entitled
"Identification and Inventory Purpose," second paragraph, be deleted and a new
second paragraph be substituted therefor so as to hereafter read as follows:
"Preservation of sites listed on the Plan shall be
encouraged and governed by Article 28A, Sections 28A-8 and
28A-9 of the Zoning Ordinance and Article IV, Division 18.
Sections 2-206 and 2-207 of the City Code of Ordinances.
Any site listed on the Plan as of August 11, 1987, shall be
given one (1) year from the aforementioned date to submit a
letter to the Department Director responsible for staffing
the Landmark Commission and the Landmark Commission
Chairperson stating the desire to remove such site from the
Plan due to the governing provisions of the Zoning Ordinance
(28A-8 and 28A-9) and City Code of Ordinances (2-206 and
2-207 )"
SECTION 2. That the third paragraph of said Chapter IV, entitled
"Identification and Inventory Purpose" containing the sentence beginning with
the following phrase "No sites shall be included in the Preservation Plan "
be amended by adding the word "additional" between the first and second words of
said sentence so that such phrase shall hereafter read as follows:
"No additional sites shall be included in this Preservation
Plan . . ."
SECTION 3. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 4. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption stating in
substance the purpose of the ordinance, this ordinance to become effective upon
such publication.
