HomeMy WebLinkAbout19956 ORD - 09/01/1987AN ORDINANCE AMENDING THE LANDMARK PRESERVATION PLAN BY ADDING A NEW CHAPTER VII ENTITLED, HISTORIC OVERLAY REGULATIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Landmark Preservation Plan be amended by adding a new Chapter VII entitled Historic Overlay Regulations, to read as follows: 03P.053.01 CHAPTER VII HISTORIC OVERLAY REGULATIONS ARTICLE I. PURPOSE. The purpose of these regulations are to ensure a property or structure with potential historic value to be reviewed by the Landmark Commission prior to new construction, exterior change, relocation or demolition, in order to preserve the historical significance of the property or structure, and to protect the character of surrounding historical properties or structures. ARTICLE II. DESCRIPTION. Section 7-1. Lots 1 through 6, Blocks 60 & 69 of Beach Portion, as shown by map or plat thereof as recorded in Volume A, pages 2 and 3, Map Records, Nueces County, Texas. Sections 7-2 - 7-9. Reserved. ARTICLE III. FACADE REVIEW CRITERIA. Section 7-10. The purpose of the "Overlay Regulations" is to authorize the Landmark Commission to architecturally and historically review the facade design of any new structure, improved structure, and relocated structure within the land area described in the foregoing Article II. Section 7-11. The Landmark Commission shall be authorized to review any structure proposed for demolition within the area described in 'Article II. The purpose of this review process is to promote the preservation of the historical and architectural significance of such structure. 19956 MICROFILMED Section 7-12. The facade of any new structure, improved structure, and relocated structure shall be of a design from the mid nineteenth century (1850) to the early twentieth century (1925) as characterized in Old Irish Town. Such styles of the facade may be built, but not limited to: Victorian, Queen Anne, Colonial Revival, East Texas Architectural, Prairie, Classical Revival, American Classic Bungalow, and Pre -World War II. Section 7-13. One elevation plan of the facade at the scale of "1" - 200' shall be submitted to the Planning Department and the Landmark Commission for review. ARTICLE IV. OVERLAY REGULATIONS. Section 7-14. Authorizing the Landmark Commission to architecturally and historically review plans for all facades of structures to be improved, newly constructed, or to be relocated on land described in this chapter. Such review process shall extend to a maximum of ninety (90) days from the first date formally scheduled on the Landmark Commission's agenda. Section 7-15. An appeal of the Landmark Commission's decision may be made in writing to the City Council through the City Secretary's office. Notice of appeal shall be filed in the office of the City Secretary no later than thirty (30) days after the Landmark Commission's decision. ARTICLE V. PROCEDURE. The Building Official is hereby authorized and directed not to issue an exterior alteration permit or demolition permit for structures situation on the herein described tract of land, and not to issue a permit to relocate a structure on said land area until the Landmark Commission has reviewed and approved such item of intent. The review and appeal process shall be the same as set forth in Section IV. The Staff liaison to the Landmark Commission shall inform the Building Official in writing not later than the next business day following said action and recommendation of the Landmark Commission. In the event of an appeal to the City Council, the City Secretary shall inform the Building Official in writing not later than the next business day following the decision of the City Council. 03P.053.01 ARTICLE VI. INCLUSION IN PRESERVATION PLAN PROHIBITED. No site described in this chapter shall be included in Chapter IV, entitled "Identification and Inventory" without the consent of the owner or owners thereof made in writing to the Director of Planning, City of Corpus Christi.
