AMENDING THE ZONING ORDINANCE UPON APPLICATION OF NUECES
ASSOCIATES, LTD. BY GRANTING A REVISED SPECIAL COUNCIL
PERMIT REWORDING CONDITION 5 OUT OF THE ORIGINAL ORDINANCE
19087 ON A PORTION OF LOTS 1, 2, AND 3, BLOCK 8, CULLEN
PLACE UNIT 1; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Nueces Associates,
Ltd., for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, September 1, 1987, at regular
Council meeting of the City Council in the Council Chamber at City Hall in the
City of Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendment would best
serve public health, necessity and convenience and the general welfare of the
City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That a revised Special Council Permit be granted on a
portion of Lots 1, 2, and 3, Block 8, Cullen Place Unit 1, situated in the City
of Corpus Christi, Nueces County, Texas, and further described by metes and
bounds below, rewording condition 5 out of the original Ordinance 19087 to read
as follows: "No alcohol will be served nor shall a full food service restaurant
be permitted nor shall any retail establishment be allowed to remain open 24
hours a day," according to the site plan, a copy of which is attached hereto and
made a part hereof, marked Exhibit "A", and subject to all other considerations
of "R -1B" One -family Dwelling District.

FIELDNOTES for 3.39 acres of land out of Lots 1, 2, and 3,
Block 8, Cullen Place Unit 1, a map of which is recorded in
Volume 51, Page 158, Map Records of Nueces County, Texas:
Beginning at a 5/8 inch iron rod set on the East line of
Airline Road for the Southwest corner of Lot 23, Block 1,
said Cullen Place Unit 1, and the Northwest corner of this
survey;

Thence, leaving said East line of Airline Road, S 87°32'00"
E, along the common line of said Blocks 1 and 8, a distance
of 27.41 feet to a 5/8 inch iron rod set for the point of
curvature of a circular curve to the right whose radius
point bears S 02°28'00" W 155.21 feet and which has a
central angle of 29°20'00", a radius of 155.00 feet, a
tangent distance of 40.62 feet and an arc length of 79.46
feet;
Thence, with said circular curve to the right, 79.46 feet to
a 5/8 inch iron rod set for the point of tangency;
Thence S 58°12'00" E, continuing along said common line of
Blocks 1 and 8, a distance of 336.90 feet to a 5/8 inch iron
rod set for an inside corner of said Block 1, for the
Northeast corner of this survey and for the point of
curvature of a circular curve to the left whose radius point
bears Southeast 417.15 feet and which has a central angle of
21°48'20", a radius of 417.15 feet, a tangent distance of
80.36 feet and arc of 158.77 feet;
Thence, with said circular curve to the left, 158.77 feet to
a 5/8 inch iron rod set for the point of reverse curvature
of a circular curve to the right whose radius point bears
Southwest 520.00 feet and which has a central angle of
17°54'30", a radius of 520.00 feet, a tangent of 81.93 feet
and an arc length of 162.53 feet;
Thence, with said circular curve to the right, 162.53 feet
to a 5/8 inch iron rod set for the point of tangency;
Thence S 02°28'00" W, continuing along said common line of
Blocks 1 and 8, a distance of 46.57 feet to a 3/4 inch iron
pipe found for the Northeast corner of a replat of a portion
of Lots 29 and 30, Section 14, Flour Bluff and Encinal Farm
and Garden Tracts, a map of which is recorded in Volume 19,
Page 8, of said Map Records, and for the Southeast corner of
this survey;
Thence N 60°56'38" W, along the common line of said replat
and Block 8, a distance of 493.27 feet to a 3/4 inch iron
pipe found on the East line of Airline Road for the
Northwest corner of said replat and for the Southwest corner
of this survey;
Thence N 02°28'00" E, along the East line of Airline Road,
parallel to the centerline thereof and 40.00 feet distant
thereof, measured at right angles thereto, 327.73 feet to
the POINT OF BEGINNING.

In the event the Board of Adjustment grants any special exception or
variance to the Zoning Ordinance, applicable to the Special Permit herein
granted, other than the one specified in this Special Permit, said Special
Permit shall be void and of no force and effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
at three regular meetings so that this ordinance is passed and shall take effect
upon first reading as an emergency measure this the 15T day of
