HomeMy WebLinkAbout19968 ORD - 09/08/1987,t AN ORDINANCE AMENDING THE ZONING ORDINANCE BY ADOPTING NEW ZONING REGULATIONS FOR SIGNS IN "B-1" NEIGHBORHOOD BUSINESS, "6-3" BUSINESS, "6-4" GENERAL BUSINESS, "I-2" LIGHT INDUSTRIAL AND "I-3" HEAVY INDUSTRIAL DISTRICTS. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. Article 12, entitled "6-1" Neighborhood Business District, Section 12-2(7) is hereby amended by deleting said section in its entirety and adopting a new section 12-2(7) to hereafter read as follows: , "Section 12-2(7). On -premise sign - One (1) freestanding sign per premise pertaining only to the use(s) conducted within the building(s), which shall not exceed twenty (20) feet in height and shall not exceed forty (40) square feet in area. The freestanding „sign shall not overhang or project into the public right-of-way and shall not utilize or incorporate flashing, moving, or intermittent illumination. No portable sign is permitted within this District. Wall signs are permitted in addition to the freestanding sign with no limitation in regard to size and number, however, shall not utilize or incorporate flashing, moving, or intermittent illumination. All wall signs must be attached flat against the wall of the building, shall not project more then eighteen (18) inches from the wall of the building or structure, and shall not project above the height of the building." SECTION 2. Article 15, entitled "B-3" Business District, Section 15-2(10) is hereby amended by deleting said section in its entirety and adopting a new section 15-2(10) to hereafter read as follows: "Section 15-2(10). On -premise sign - One (1) freestanding sign within the minimum depth of each front yard, as specified in Articles 24 and 27 of this Ordinance, not to exceed forty (40) square feet in area or twenty-five (25) feet in height and pertaining only to the uses(s) conducted within the building(s) located on the premise. In the event of two (2) front yards overlapping at a corner, the area of overlap shall be designated as only one (1) front yard. A sign located within the front yard shall not overhang or project into the public right-of-way nor utilize or incorporate flashing, moving, or intermittent illumination. Signs in this district are further regulated by Ordinance No. 11274, Highway Beautification Ordinance, implementing the Texas Highway Beautification Act (Article 4477-9A, V.A.C.S. - Article IV, Sections 4.01-4.12) which ordinance by this reference is hereby adopted as the supplementary outdoor sign regulations for this zoning district and by this reference is incorporated herein as though set forth in its entirety." SECTION 5. Article 21, entitled "I-3" Heavy Industrial District, Section 21-2(3) is hereby amended by deleting said section in its entirety and adopting a new section 21-2(3) to hereafter read as follows: " Section 21-2(3). On-premise freestanding sign and billboard - One (1) freestanding sign not to exceed forty (40) square feet in area or twenty-five (25) feet in height is allowed within a minimum depth of each front yard as specified in Articles 24 and 27 of this Ordinance. In the event of two (2) front yards overlapping at a corner, the area of overlap shall be designated as only one (1) front yard. Article 20, entitled "I-2" Light Industrial District, Section 20-2(1) and Section 20-2(2) are hereby amended by deleting the same and adopting new sections 20-2(1) and 20-2(2) respectively so as to hereafter read as follows: "Section 20-2(1). Any use permitted in the "B-5" Primary Business District except for signs as enumerated in Item (2) below and except for dwellings, hospitals, institutions, or other buildings used for permanent of temporary housing of persons as described in Item (3) below. Section 20-2(2). SECTION 6. Article 26 entitled NON -CONFORMING USES is hereby amended by adding a new Section 26-11 as follows: "Section 26-11. All portable signs prohibited by an amendment to this ordinance are hereby declared to be non -conforming uses and the use of such portable signs shall be discontinued not later than one (1) year from the date of passage of said ordinance. Such non -conforming use shall not be extended or enlarged in any manner during said one (1) year term." SECTION 7. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 8. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption stating in substance the purpose of the ordinance, this ordinance to become effective upon such publication. 06P.110.01 That the foregoing ordinance was second reading on this the /1 following vote: Betty N.
