HomeMy WebLinkAbout19990 ORD - 09/29/1987AN ORDINANCE AMENDING THE CITY CODE, CHAPTER 17, FINANCE AND TAXATION, ARTICLE I, IN GENERAL, BY ADDING A NEW SECTION 17-14, SELF INSURANCE; CLAIMS SETTLEMENT; PROVIDING FOR SEVERANCE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Code, Chapter 17, Finance and Taxation, Article I, In General, is hereby amended by adding a new Section 17-14, Self insurance; claims settlement, to read as follows: Sec. 17-14. Self insurance; claims settlement. A. The City Self -Insurance Fund, as funded in the annual budget or by amendments thereto, shall provide coverage for property and casualty losses, general liability, auto liability, public official liability, liability for loss of money or securities, property losses, workers' compensation, fire, police, Emergency Medical Technician/Paramedic, and other miscellaneous risks to the extent not covered by contractual insurance or other indemnification. No part of said Fund shall be expended for any purposes other than the losses or liabilities of the City; or the losses and liabilities of City officers, employees, and agents, where indemnification is required by the ordinance for legal defense of City officers and employees, or by other law, or authorized by the City Council; or for administrative expenses associated with the Self -Insurance Fund. B. The City Manager or his designee may establish administrative procedures for the settlement and payment of claims. C. Authority to settle and pay claims from the Self -Insurance Fund is expressly delegated to the officials and in the amounts set forth below: Authorized Official Dollar Amount Workers Compensation Risk Management Director City Manager $0 - $60,000 $60,000 - $80,000 All Other Claims Risk Management Director $0 - $20,000 Risk Management Director/ City Attorney (Jointly) City Manager 08P.106.01 $20,001 - $40,000 $40,001 - $60,000 19990 M1gRO U&ED All settlements in excess of such amounts shall be approved by the City Council. D. The City Manager shall cause a professional acturial audit of the Self -Insurance Fund at least every two years to determine its adequacy in accordance with prevailing standards in the insurance industry. SECTION 2. Ordinance No. 18188 is repealed. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall take eff ct upon first reading as an emergency measure this theQ9 day of 1 1i�19t .
