HomeMy WebLinkAbout20003 ORD - 10/06/1987AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CHAPTER 12, BOATS, BAYS AND WATERWAYS, SECTION 12-61, RATES AND RENTAL FEES FOR USE OF SLIPS AND DOCK SPACE --SCHEDULE AND REGULATIONS, BY INCREASING SLIP RENTAL RATES AND OTHER FEES; PROVIDING FOR SEVERANCE; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances, Chapter 12, Boats, Bays and Waterways, Section 12-61, Rates and rental fees for use of slips and dock space --Schedule and regulations, is hereby amended by repealing subsections (1), (2), and (3) of Section 12-61 and substituting the following therefor: "Sec. 12-61. Rates and rental fees for use of slips and dock space --Schedule and regulations. (1) DEFINITIONS: Boat Slip: An area designated for wet boat storage including one half (1/2) of the adjacent catwalk and/or pier, as designated on the marina slip schedule. Berths: A designated area of dry boat storage where a craft canoe suitably placed on racks or cradles when not in use. Dockage: A craft lying alongside a dock, pier, or bulkhead having the benefit of only a single -side mooring. Moorages: Areas to moor a craft for storage by anchor or to ma fast to a spar, cleat, post or piling, usually without the benefit to secure on four (4) corners of the craft or unable to lay off. Charter Boat: Any crafts referred to as a head boat, party boat, party fishing boat, charter fishing boat, tour boat, excursion boat, and sightseeing boat, which are for temporary charter, rent or hire for recreational purposes all shall be construed to mean they are charter boats. Where there are no special provisions of the Code of Ordinances provided concerning charter boats at the marina, the Code of Ordinances regulating all other watercraft at the marina shall also apply to the charter boats. 08P.024.01 20003 MICROFILMED Suitable Size Slip: A slip with reference to a particular boat which can physically and safely accommodate such boat as determined by the marina superintendent, considering both the safety of the vessel and the city property. Transient Craft: Craft having port -of -call other than the Corpus Christi Municipal Marina which is seeking overnight dockage at the marina. Limited Tap Water: The tap water provided at the various boat slips shall not be used in continuous running water jet pumps and in tap water cycling machinery; i.e. cooling plants. Unauthorized Craft: Any craft moored, docked, or slipped in the Corpus Christi Marina without a current rental contract or prior written permission for the specific period in question. Any craft which is in the marina after cancellation of the slip contract or after the period ends for which it has written permission shall automatically be defined an unauthorized craft. Temporary Craft: A watercraft moored, docked or slipped in the Corpus Christi Marina, with written permission of the marina superintendent, not meeting the definition of transient craft, but without a monthly slip rental contract in effect. Pleasure Craft Slip: For tenants who do not make a profit from slip or boat and are used for recreational activities. Commercial Craft Slip: For tenants who use the marina for commercial operations, i.e, Shrimpers, Charters, Brokers, etc. Linear Footage: Measurement used to calculate slip rates based on length overall of vessel or slip, whichever is greater. (2)(a) MONTHLY RATES AND RENTAL FEES: The monthly rate and rental fee for Pleasure and Commercial craft slips in the Corpus Christi Marina shall be calculated on the linear foot of the vessel or slip, whichever is greater. The fee includes a limited amount of tap water. Twenty dollars ($20) per month additional charge shall be placed on slips rented to parties who do not maintain a primary permanent residence in the city. 08P.024.01 08P.024.01 N SCHEDULE OF RATES: The rates per linear foot shall be as follows: CITY FISCAL YEAR PLEASURE COMMERCIAL 87-88 $ 2.30 $ 3.80 88-89 3.05 4.55 89-90 3.70 5.20 90-91 4.25 5.75 91-92 4.70 6.20 92-93 5.05 6.55 93-94 5.30 6.80 94-95 5.40 6.90 95-96 5.40 6.90 96-97 and thereafter 5.45 6.95 (b) In addition, an electricity surcharge will be added to the monthly charge determined by the length of craft within a slip, as follows: PLEASURE COMMERCIAL Craft up to twenty (20) feet in length $ 3.00 $ 7.00 Craft more than twenty (20) up to thirty (30) feet in length 5.50 9.50 Craft more than thirty (30) up to forty (40) feet in length 10.50 14.50 Craft over forty (40) feet in length 19.00 23.00 Meters shall be installed by the city to determine if the monthly surcharge is inadequate; where an increase in service above the surcharge rate exists, actual usage will be applied. In addition, charter boat tenants shall obtain their own source of electricity and, at their own expense, make any connections required by the utility company and pay for such usage of electricity. (c) Berths in dry boat dock: The rate for berths in the dry boat dock shall be: 1. Thirteen dollars ($13.00) per month for each lower level berth. 2. Ten dollars ($10.00) per month for each second level berth. 3. Ten dollars ($10.00) per month for each third level berth. (d) Rates for temporary craft: Temporary craft shall be charged a slip or dockage fee at the same rate as transient craft. (e) Rates for unauthorized craft: All unauthorized craft shall be charged a rental or storage fee of twenty-five dollars ($25.00) per day. (f) Rates for transient craft: Transient pleasure craft shall be charged a boat slip or dockage fee of twelve dollars ($12.00) per day (constituted as staying overnight), plus an additional charge of two dollars ($2.00) for limited use of tap water and electricity when utilized. Commercial transient craft such as shrimp boats or crew boats for oil rigs shall be charged a boat slip or dockage fee of twenty-five dollars ($25.00) per day, plus an additional charge of two dollars ($2.00) for limited use of tap water and electricity when utilized. The fee shall be payable in advance daily and the length of stay for pleasure craft shall not exceed thirty (30) days. The length of stay for commercial craft shall be dependent upon the length of time of the task assigned that commercial craft and as approved by the marina superintendent. A transient craft cannot be registered at the marina as a transient and on the waiting list for a boat slip at the same time. Transient craft may be assigned to slips where the regular slip tenant's craft is temporarily out on cruises or ways. The regular slip tenant must report to the marina supervisor when he will be out of his slip for a period of two (2) or more days. The marina superintendent is authorized to use unoccupied slips due to cancellations, contract turnovers, or awaiting 08P.024.01 craft arrivals for short-term tenants at the following rates: Day Rate Weekly Rate (7 Days) Monthly Rate (30) Days) $12.00 per day or $.50/ft. whichever is greater. $75.00 per week or $3.12/ft. whichever is greater. $270.00 per month or $11.25/ft. whichever is greater. Electrical fees are $2.00/day or metered at the current rate for metered craft. (g) Rental of gear boxes: Rental of standard gear boxes provided by the city shall be three dollars and fifty cents ($3.50) per month for the large boxes and three dollars ($3.00) per month for the small gear boxes. (h)1 dollars ($15.00) per day will h twenty-four (24) hour period. (i) Group Rates for Regattas, Rates will be pro -rated based pleasure boat slips used. (j) Other Special Services: Tenants whose vessels become a hazard to public property and/or other vessels or require emergency service, i.e. pumping out, reberthing, installation or tightening of mooring lines, will be charged the cost of materials required, plus a 20 percent surcharge and twenty-five dollars ($25.00) per hour for services provided by marina personnel. The marina superintendent or his designee shall have the authority to determine the necessity for such services. (3) THE SLIP CONTRACT: The rates and rentals set forth herein shall be part of any slip rental contract under Section 12-79." That the Code of Ordinances, Chapter 12, Boats, Bays and Waterways, be amended by adding a new Section 12-81, Unoccupied slips, to read as follows: Sec. 12-81. Unoccupied slips. No Lessee shall fail to occupy his or her assigned slip with a boat for a period of more than 120 consecutive days. 08P.024.01 SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflicts. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 5. Section 1 of this ordinance shall after March 1, 1988, and the remaining provisions shall after November 1, 1987. SECTION 6.
