HomeMy WebLinkAbout20039 ORD - 10/27/1987, AN ORDINANCE ANNEXING 11 AREAS CONTAINING 33,172.02± ACRES OF GOVERNMENTALLY OWNED LAND. WHEREAS, on September 2, 1987, September 16, 1987, and September 8, 1987, public hearings were duly held following publication of due notice of said hearing in the official newspaper, pursuant to Article 970a, V.A.C.S., Texas, as amended, for the consideration of institution of proceedings for the annexation of defined area wholly within the extraterritorial jurisdiction of the City of Corpus Christi, more particularly described by metes and bounds as hereinafter set forth, at which all interested persons were afforded an opportunity to be heard, and by motion duly made, seconded and carried the said hearing was closed September 16, 1987; and WHEREAS, it has been determined by the City Council that the territory within said tract or parcel of land, now proposed to be annexed, abuts and is contiguous and adjacent to the City of Corpus Christi and constitutes lands and territories subject to annexation as provided by the City Charter Article I, Section 2c; and WHEREAS, it has been determined that it would be advantageous to the City and to its citizens and in the public interest to annex the aforesaid lands and territory hereinafter described: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the tracts or parcels of land as set forth in the attached Exhibit A are hereby annexed, said parcels or tracts being described by metes and bounds as shown therein. The said described areas shall hereafter be a part of the City of Corpus Christi, Texas, and shall be subject to the general laws of the State of Texas, the City Charter, and the ordinances, resolutions, motions, laws, rules and regulations of the City of Corpus Christi, to all intents and purposes as the present City of Corpus Christi is so subject, and subject to all the rights, privileges and burdens thereof. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. 08P.126.01 20039 MICROFILMED 'TRACT A-1 A segment of U. Highway 77 R.O.W. containing 1.40 acres, more or less, described by metes and bounds as follows: Beginning at a point on the present city liit line as established by Ordinance No. 6636, dated September 19, 1962, the intersection of the northwesterly extension of the southwest boundary line of Country Estates Subdivision Unit 11, as shown on Plat of Record in Volume 49, Pages 175 and 176, Nueces County Map Records, Nueces County, Texas and the old west R.O.W. like of approximately 100 foot wide, U. TRACT B-1 A city -owned 151.0 acre tract of land, more or less, out of Lots 1, 2, 5, and 6, Section 16 of Bohemian Colony Lands, as shown on Plat of Record in Volume A, Page 48, Nueces County Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: Beginning at a point on the present city limit line, as established by Annexation Ordinance No. 13701 dated April 21, 1977, its intersection with the west R.O.W. line of 60.00 foot wide Greenwood Drive for the northwest corner of this tract; Thence in a southeasterly direction with said present city limit line, a distance of 3,020 feet, more or less, to a point for the northeast corner of this tract; Thence in a southwesterly direction with a line parallel to said west R.O.W. line of 60.00 foot wide Greenwood Drive, and approximately 3,020 feet distant therefrom, to a point on the northerly low waterline of the Oso Creek for the southeast corner of this tract; Thence in a westerly direction with the meanders of the northerly low waterline of the Oso Creek, to a point, its intersection with the southerly extension of the west R.O.W. line of 60.00 foot wide Greenwood Drive for the southwest corner of this tract; Thence in a northeasterly direction with said west R.O.W. line of 60 foot wide Greenwood Drive, to a point, for the point of beginning. WHEREAS, on September 2, 1987, September 16, 1987, and September 8, 1987, public hearings were duly held following publication of due notice of said hearing in the official newspaper, pursuant to Article 970a, V.A.C.S., Texas, as amended, for the consideration of institution of proceedings for the annexation of defined area wholly within the extraterritorial jurisdiction of the City of Corpus Christi, more particularly described by metes and bounds as hereinafter set forth, at which all interested persons were afforded an opportunity to be heard, and by motion duly made, seconded and carried the said hearing was closed September 16, 1987; and WHEREAS, it has been determined by the City Council that the territory within said tract or parcel of land, now proposed to be annexed, abuts and is contiguous and adjacent to the City of Corpus Christi and constitutes lands and territories subject to annexation as provided by the City Charter Article I, Section 2c; and WHEREAS, it has been determined that it would be advantageous to the City and to its citizens and in the public interest to annex the aforesaid lands and territory hereinafter described: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the tracts or parcels of land as set forth in the attached Exhibit A are hereby annexed, said parcels or tracts being described by metes and bounds as shown therein. The said described areas shall hereafter be a part of the City of Corpus Christi, Texas, and shall be subject to the general laws of the State of Texas, the City Charter, and the ordinances, resolutions, motions, laws, rules and regulations of the City of Corpus Christi, to all intents and purposes as the present City of Corpus Christi is so subject, and subject to all the rights, privileges and burdens thereof. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase', word orprovision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect -any other section, paragraph, subdivision, clause, phrase, word or provisioAf•this ordinance, for it is the definite intent of this City Council that��every,.section, paragraph, subdivision, clause, phrase, word or provision hereof`be`!°given full force and effect for its purpose. 3011-10 08P.126.01 20039
