HomeMy WebLinkAbout20046 RES - 11/03/1987A RESOLUTION AUTHORIZING CITY PARTICIPATION IN TEXAS PUBLIC UTILITY COMMISSION DOCKET NO. 7560 AND SELECTION OF LEGAL COUNSEL AND CONSULTANTS THEREIN. WHEREAS, on June 24, 1987, Central Power and Light Company filed a petition with the Texas Public Utility Commission requesting an order allowing CPL to defer certain costs on the South Texas Nuclear Project Unit No. 1; and WHEREAS, the Steering Committee for the CPL Service Area Cities requested the opinion of its attorney, Don Butler, as to the effect of this filing and was advised that such an order will increase the cost of the nuclear project, may result in a rate increase, would constitute retroactive and piecemeal ratemaking, and would unfairly shift the risk of nuclear construction to ratepayers; and WHEREAS, the Steering Committee recommended intervention into this case, Docket 7560, to protect the Cities' interest; and WHEREAS, authorization for participation does not obligate the City to any amount of payment. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The City authorizes its legal counsel to file participation in its behalf in Docket 7560, Petition of Central Power and Light Company for Approval of Deferred Accounting Treatment of Certain Costs Related to the South Texas Nuclear Project Unit No. 1, as a named party along with other participating cities. SECTION 2. The City approves the selection by the steering Committee of Don R. Butler of Austin, Texas, as its attorney, and authorizes the witnesses and attorneys selected by the Steering Committee to act on behalf of the City to obtain all information necessary and pertinent, to conduct investigations, present evidence, make filings in the City's name and advise and represent the City in Docket 7560, including any appeals from Commission decisions thereon, all subject to the authorization and direction of the Steering Committee. SECTION 3. The authority herein may be terminated at any time by written notice and does not obligate the City for payment of any amount.
