AUTHORIZING THE EXECUTION OF AGREEMENTS WITH THE STATE
DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR THE
CITY'S PARTICIPATION IN THE RECONSTRUCTION OF PADRE ISLAND
DRIVE FROM THE OSO BAY TO THE LAGUNA MADRE; AND
APPROPRIATING $607,475.61.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute
agreements with the State Department of Highways and Public Transportation for
the City's participation in the reconstruction of Padre Island Drive from the
Oso Bay to the Laguna Madre, all as more fully set forth in the agreements,
substantial copies of which are attached hereto and made a part hereof, marked
Exhibits A, B, C, D, E, and F.
SECTION 2. That there is hereby appropriated $607,475.61 from the
No. 561 Street Bond Fund applicable to Project No. 561-86-1.5, Padre Island
Drive from Oso Bay to Laguna Madre.

THIS AGREEMENT, made this day of , 1987, by and
between the City of Corpus Christi, Texas, hereinafter called the "City",
Party of the First Part, acting by and through its City Manager and the
State of Texas, hereinafter called the "State", Party of the Second Part,
acting by and through its State Highway and Public Transportation
Commission.
WHEREAS, it is the desire of the State and City to construct a roadway
illumination system within the limits from east of Laguna Shores Road to
0.L mile east of Waldron Road on State Highway No. 358. The State will
perform or have performed this work and the City will pay fifty per cent
(50%) of the cost of this work estimated to be Ninety One Thousand Three
Hundred Six and 71/100 Dollars ($91,306.71), excluding preliminary
engineering. It is estimated the City's share is Forty Five Thousand Six
Hundred Fifty Three and 36/100 Dollars ($45,653.36), including
contingencies and construction engineering.
NOW THEREFORE, it is understood that the State will perform or have
performed this proposed work. The total estimated cost of this work
amounts to Ninety One Thousand Three Hundred Six and 71/100 Dollars
($91,306.71). The City will pay fifty per cent (50%) of the cost of this
work and it is estimated the City's share is Forty Five Thousand Six
Hundred Fifty Three and 36/100 Dollars ($45,653.36), and the City will
transmit to the State with the return of this agreement, executed by the
City, a warrant or check made payable to the State Department of Highways

Fifty Three and 36/100 Dollars ($45,653.36), to be used in paying for the
City's share of the proposed work. If at any time it is found that this
amount is insufficient to pay the City's portion, then the City upon
request of the State will forthwith supplement this amount by an amount
equal to the City's full estimated or actual share of the cost of this work
less the amount previously paid to the State Department of Highways and
Public Transportation. In the event the amount as paid is more than the
actual cost of the City's share, as herein established, then the excess
amount will be returned to the City.
IN TESTIMONY WHEREOF, the parties hereto have caused these presents to
be executed in duplicate on the day above stated.

State of Texas, hereinafter called the "State", Party of the Second Part,
acting by and through its State Highway and Public Transportation
Commission.
WHEREAS, it is the desire of the State and City to construct a roadway
illumination system within the limits at Waldron Road on State Highway
No. 358. The State will perform or have performed this work and the City
will pay fifty per cent (50%) of the cost of this work estimated to be
Forty Two Thousand Eight Hundred Seventy and 78/100 Dollars ($42,870.78),
excluding preliminary engineering. It is estimated the City's share is
Twenty One Thousand Four Hundred Thirty Five and 39/100 Dollars
($21,435.39), including contingencies and construction engineering.
NOW THEREFORE, it is understood that the State will perform or have
performed this proposed work. The total estimated cost of this work
amounts to Forty Two Thousand Eight Hundred Seventy and 78/100 Dollars
($42,870.78). The City will pay fifty per cent (50%) of the cost of this
work and it is estimated the City's share is Twenty One Thousand Four
Hundred Thirty Five and 39/100 Dollars ($21,435.39), and the City will
transmit to the State with the return of this agreement, executed by the
City, a warrant or check made payable to the State Department of Highways

and Public Transportation in the amount of Twenty One Thousand Four Hundred
Thirty Five and 39/100 Dollars ($21,435.39), to be used in paying for the
City's share of the proposed work. If at any time it is found that this
amount is insufficient to pay the City's portion, then the City upon
request of the State will forthwith supplement this amount by an amount
equal to the City's full estimated or actual share of the cost of this work
less the amount previously paid to the State Department of Highways and
Public Transportation. In the event the amount as paid is more than the
actual cost of the City's share, as herein established, then the excess
amount will be returned to the City.

this work and the City will pay fifty per cent (50%) of the cost of this
work estimated to be One Hundred Seventy Seven Thousand Nine Hundred Sixty
Four and 12/100 Dollars ($177,964.12), excluding preliminary engineering.
It is estimated the City's share is Eighty Eight Thousand Nine Hundred
Eighty Two and 06/100 Dollars ($88,982.06), including contingencies and
construction engineering.
NOW THEREFORE, it is understood that the State will perform or have
performed this proposed work. The total estimated cost of this work
amounts to One Hundred Seventy Seven Thousand Nine Hundred Sixty Four and
12/100 Dollars ($177,964.12). The City will pay fifty per cent (50%). of
the cost of this work and it is estimated the City's share is Eighty Eight
Thousand Nine Hundred Eighty Two and 06/100 Dollars ($88,982.06), and the
City will transmit to the State with the return of this agreement, executed

by the City, a warrant or check made payable to the State Department of
Highways and Public Transportation in the amount of Eighty Eight Thousand
Nine Hundred Eighty Two and 06/100 Dollars ($88,982.06), to be used in
paying for the City's share of the proposed work. If at any time it is
found that this amount is insufficient to pay the City's portion, then the
City upon request of the State will forthwith supplement this amount by an
amount equal to the City's full estimated or actual share of the cost of
this work less the amount previously paid to the State Department of
Highways and Public Transportation. In the event the amount as paid is
more than the actual cost of the City's share, as herein established, then
the excess amount will be returned to the City.

concrete sidewalk, concrete driveways and incidental items within the
limits from east of Laguna Shores Road to 0.2 mile east of Waldron Road on
State Highway No. 358, which is solely the City's responsibility and the
City has requested the State to construct or have constructed this work.
The State will construct or have constructed this work for and on behalf of
the City and at the City's sole expense, including preliminary engineering.
The estimated construction cost of this work is Forty Two Thousand Sixty
Eight and 40/100 Dollars ($42,068.40), including contingencies and
construction engineering.
NOW THEREFORE, it is understood that this proposed work will be
constructed by the State and the City will transmit to the State with the
return of this agreement, executed by the City, a warrant or check made
payable to the State Department of Highways and Public Transportation in
the amount of Forty Two Thousand Sixty Eight and 40/100 Dollars
($42,068.40), to be used in paying for the proposed work required by the
City in the City of Corpus Christi. It is further understood that the

State will construct only those items for the City as requested and
required by the City and the entire cost of such items, including
preliminary engineering, will be borne by the City. If the State elects to
receive bids and if upon receipt of bids by the State and/or the actual
construction and/or approved changes in the contemplated improvements it is
found that this amount is insufficient to pay the City's portion, then the
City upon request of the State will forthwith supplement this amount by an
amount equal to the City's full estimated or actual share of the cost of
this work less the amount previously paid to the State Department of
Highways and Public Transportation. In the event the amount as paid is
more than the actual cost, then the excess amount will be returned to the
City. It is further understood that the work to be done on behalf of the
City, as herein provided, will include the cost of contingencies and
construction engineering.
